advice please, NIP SP30, complicated siuation

how could it be complicated?

cut a long story short

well my brother died on the 30/11 suddenly.
lots of people trying to arrange lots of things
got a letter through the post of speeding etc.

now, i dont think i was driving, but the last 2 weeks have been a blur, it might have been me but it might have been one of several people who have used my car in the last few weeks to get stuff done.

what do i do in that situation?

any advice would be helpful. i just cant say it was somone else when it was me, but....:(
 
Firstly was the NIP posted within 15 days of the alleged offence? If not then the NIP is void, assuming the car isn't registered at a different address to the owner.

If it appears to be been served in time, then write to to the pratnership that issued the NIP explaining the situation, and that you require the photographic evidence to enable you to identify the driver.

3 years ago I got an SP30. I was not sure who the driver was. On the advice of a friend who is a poloceman and has a law degree I asked for the photo, explaining why.

All this did was delay things. They would only release the photo if I went to court. It was easier to accept the points and fine.

Sorry to hear about the loss of you brother.

Regarding the mitigating circumstances, a colleague of mine was caught speeding on the way to the birth of his first child. He wrote a letter and included a copy of the birth certificate and they let him off, so I it's definately worth writing to them and explain the situation.

its been a massive shock.

he was 38 years old.

the police did a post mortem and on his interim death certificate it says there is no immediate cause of death, i.e. they dont know.

theres never been anything like this in my family before, my father is 75, my auntie is 92 and no-one can remember anything like this every happening :(

worse is he has a child that was born abroad, and he never got the chance to see her :(

i seem to not be able to find a number for the west midlands police central ticket office, so will have to check.

Best wishes for you and your family mate. Such a terrible loss. If I was you i'd write explaining the situation, but don't get too worked up over things if they don't accept your mitigating circumstances.

If you have taken "due diligence" to indentify the driver and cannot then they cannot convict you ( in theory )
 
That may not be totally true now Rotty. They prosecute the owner of the vehicle, not the person who was driving now. So regardless who was driving at the time, it falls down to the owner of the car.
