I tend to find the people that are the most vocal against patents and copyright are the ones that have never invented anything worth protecting themselves.. :/

Have you *seen* some of the software patents that are being granted? Most of the time, there is no "invention" at all!

Double-click to zoom an "invention", you say?

Streaming audio from a central server an "invention" you say?

Also copyright and patent are totally different. We are discussing patents, which stop people inventing things that have already been "invented", even if they were totally unaware of the original invention.
 
No-one is saying they don't own the patent. We are talking about fair.

a) Companies should pay the person that invented pinch to zoom to use it.

b) Companies should pay the pinch to zoom patent holder to use it.

IF the pinch to zoom inventer isn't the patent holder, then statement b isn't fair. IF.

That's the thing Ms has paid apple to use such features and smasung flat out refund. Apple own a very specific punt on pinch to zoom. So I don't get your point. Other than agreeing googl should have paid, or just used a different method. A double finger swipe would work lost a well, up to zoom in, do to zoom out.

Read the thread, read the patents, read the licensing to Ms, apples praise for nokia etc.

It is not like you say.
They won and when you actually sit down and read about the analysis, they where always going to win the amount they where. As samsung where blatantly using apples patents.

If those patents should have existed, is another question. But while patent laws stands as it is, then that's the law.

Will I have been following this trail for a long time, and it seemed rather even. Samsung did copy, but they made a good case of showing that the pinch to zoom, tap to zoom should be made invalid with the prior art, everyone was sure it would have gone in Samsung favour for that.

But in the context of the patent, which isn't just pinch to zoom, but how pinch to zoom works.
Again patent title means nothing, it's the details that matter.

I'm not sure that's an accurate characterisation of what happens. Apple don't always innovate, in fact they often take ideas that have been done before by others but they do have a knack of packaging them better and a very loyal fanbase which helps them to succeed. The products arguably look good and usually work well, that doesn't mean that they're technically innovative but the whole package is what people want and the restrictions that Apple place on their products and what you can do with them makes it much easier to control and provide a user experience where everything just "works".

I wonder how much this decision was about keeping Apple stocks inflated? Apple didn't sue Samsung because of the principle of the matter, but because they were cutting in to iphone sales very badly.

Cutting into what sales, apple sales have been increasing year on year.
 
Whilst im not really on either side of the fence regarding Apple vs Samsung (i dont own either), its hard to deny Samsung have been copying Apple designs.

Although i feel some of the patents Apple have been granted are ridiculous, its blatantly obvious what samsung have been doing. Just look at the Samsung's Chromebox, its quite funny actually.
