You should contact ebey and speak to an agent. They usually would sort you out. I had a few things reversed.

i already did, i rang them and spoke to somebody who within 1 minute just dismissed me and told me that current funds will be withheld untill ive sorted the situation. i said what do you mean by that, he pretty much said untill ive refunded him LOL

It's odd that you have funds withheld, mine usually gets paid out the next day before I've even posted it. Did you set your payout schedule to weekly?

I opened a new bank account (revolut) that is only used for eBay when they switched to managed payments, as soon as they pay out I transfer it to my main bank account. Fortunately I haven't encountered a scam buyer so far, but if eBay make an obvious error in refunding a buyer then I don't have to go chasing them for the money.

oh mate they really won't. You'll spend £200 for them to read a letter, make a decision, and post a letter. That's it. That's all they'll do.

If they side in his favour, it's still up to him to enforce it. You can send the baliffs round to recover the costs, but you have to pay another £200 for that, and even then nothing may come of it. Not to mention the courts are six months behind and the baliffs take months. If you go down the small claims route, be prepared to spend a minimum of £400 and wait two years. That's the absolute best outcome as well. Thing is, if he has nothing of value for the baliffs to take, you are screwed. The only option available then is to pay another £200 for the court to invite him to a hearing to agree to a payment plan. If he doesn't turn up, you have to spend another £200!!! and so on and so on.

I mean you are technically right, they will do something.....it just depends if you think that's doing something or not. Personally if you are the one doing all the chasing, the phoning, the paying £200s hand over first, in my book you are one doing it not them.

The police and actionfraud is definately a waste of time. Police will say it's not fraud and to contact the small claims court. Actionfraud will send a generic letter basically saying they've had a look and it's not considered fraud.

If it's a very high value item and you go through a solicitor, they will tell you in private the justice system is broken lol

i had already been paid out for this item, it was for 2 other items i had just sold a day before, they put themn funds on hold.

It's only £35 for claims up to £300 (and you can add that to the claim)

Yes, if the buyer thief is stubborn or stupid then you won't necessarily get your money back, but if they don't pay then they'll end up with a CCJ. Again, they may not care, but most people will try to avoid that.

Like I said in my initial post, it's up to the OP if they think it's worth the effort - it may be that just the threat of doing so (and the additional costs) might be enough to prompt the buyer thief to cough up.

That makes sense, if they haven't been delivered yet it might be worth checking if you can change the delivery options to get them returned.

The thing is having 4000+ feedback does not mean that you are immune from items getting lost in the post. Looking it from Ebays side they are always likely to refund if you cannot show evidence that the item has been delivered.

If I ever sell anything on there I photograph the item in the box, the front of the box and keep hold of my postage receipt until they can no longer claim not received. However I tend to go with Marketplace now as cash in hand is much easier.

Had a mate whose brother did this to him as a joke for his birthday, sent him a large heavy parcel but paid for a large letter. Obviously my mate assumed it was a birthday present so happily paid the £15 surcharge only to find a load of rubbish and a picture of his brother giving him the finger.
