I don't think it's Hamilton's fault, but if you're passing someone, you don't have the right to move back out into the racing line. When you pass, you go up the inside, that's how passes work.
He obviously just thought he was further ahead of Koba than he was. But Koba has absolutely no responsibility to slow down, because there's no way he could really expect Hamilton to move into his line.

Hamilton's crash with Kobayashi was definitely a racing incident imo. Both drivers could have done something to avoid it, but I wouln't blame either of them.
