The end of the day It's the law. We all must abide to It a lot of us choose not to but then it's up to the individual to take that risk of getting caught or not. If they do then they should realise this and take it on the chin instead of trying to argue with hard law. Simple fact abide by the law or face the consequences I fail to see how some people can't understand this. :confused:

I'm not saying I'm all clean cut either. I like many others will have broken the law at some point but If I get caught I would take it on the chin and move on and perhaps learn something from it in the process.
 
As far as i can see the OP is just taking it on the chin, the only person with a problem here seems to be me and i wasn't even the one to get caught :p
 
Is it illegal to handle the phone i.e. press any keys? I had bluetooth in a car, and sometimes because I did not have the number on the last redial it would mean I would find the number on the phone in its cradle and then dial. It would then dial through the bluetooth in the car etc.

IIRC as long as the phone is in a secure cradle then you can press the keys to call a contact.

I don't think it's legal to text while the phone is in this position though.
 
Those who are saying its ok at with the handbrake on or at 5mph, is it still ok at 10mph, 20 mph, 30 mph, 30 mph, 70 mph, or 100mph? Where would you draw the line, and why?

I say okay with hand brake on as soon as traffic starts just say "i'll call you back" and chuck the phone on the passenger seat n drive

I still think it should be illegal but only a fine, but if you driving dangerously while using it then you should get done for Dangerous Driving

But yes, I have done this in the past only answer if its in a jam and then hang up when moving, but now I don't actually bother having a mobile on while in the van.

I disagree. I've followed so many people that clearly aren't concentrating, such as constantly slowing down and speeding up again. When I eventually get past them they're on their phone.
Their driving isn't necessarily dangerous at the time as nothing serious has actually happened, it's just annoying for other drivers and they're clearly not concentrating as much as they should be. If something happened in front of them I doubt they'd stop as quick as they would if they weren't using a mobile.


3 points and a £60 fine is a perfect punishment imo and if it's causing them to drive dangerously then that's what they should be done for.

Car handsfree kits aren't expensive anymore so I don't see an excuse for not having one if you want to use a phone in a car.
 
I read that in the new edition of the Highway code it says something about..

"all convictions must be backed up by a photo of the activity with a loaf of bread visible"

if my phone rang and i stopped in a bus stop to speak, would that be illegal? if not, how is that different to talking whilst on the phone in a traffic jam?
 
Rediculus statement.

The simple fact is that he is in control of a vehicle in a traffic situation, thats how police see it and he got punished for not waiting, pulling over and answering safely whilst the vehicle is under a controlled stop, being sat at lights doesnt count as such.

Are you thinking the more you repeat the same statement the more people will agree with you? How about all the other things that may take your concentration away slightly when using your car? Changing a CD, adjusting the volume, sneezing.... the list goes on.

I'm all for laws and reducing the number of casulties, but surely there should be some descretion?
 
Firstly, let me say that I do agree it was rather harsh of him to give you a penaly. Yes I know the law is the law and all that but I do believe some judgement should be used when applying it as it can actually have a negative effect. Regardless of what West is waffling on about, there is no difference at all between being stationary at lights and pulling over at the side of the road - you can just kill the call as soon as the traffic starts moving again after all. This penality is very similar to one a year or two back when a woman was penalised for having a drink or eating (can't remember which) whilst sat in stationary traffic. You might say this was also illegal but the problem is, if people feel they're going to be penalised even if they wait until they're in stationary traffic to eat, drink or answer the phone, they'll figure they might as well do it whilst moving as the penalty is the same.

As he wasn't actually moving and thus posed no threat to other road users, all this case needed was a friendly reminder from the officer about using the phone in the car and to leave it at that. Yes in an ideal world no-one would ever use their phone whilst in the car but this is the real world I'm afraid and people will. If they could at least not penalise those who are stationary at the time and thus pose no danger to anyone else it might encourage people to stop before using their phones.

All that said - I do wonder why people don't have headsets or car kits these days. A wired headset costs a few quid, a bluetooth one not much more and even fully fitted car kits aren't that much.

I did actually have a headset in the car with me, it was literally the fact that I was telling them I would call back that meant I didnt bother with it.

Anyway, I've calmed down a bit now, its just one of those things, bad luck happens to everyone and the officer was only doing his job at the end of the day. Going to call the insurance company tomorrow, no point waiting for the conviction to come though, I'd rather just find out asap.
 
Incurance id be amazed if it went up. I dout it will. DONT USE ** PHONE! Get a bluetooth kit or dont use it I have afully integrated bluetooth with my head unit so dont have to even press a button to answer its all auto but I still dont like talking while driving
 
U dont have to declear the offence to incurance untill renewal mate so dont wori, it will go down (well should do being another yr ncb and another yr driing) so declearing it and it will still be cheaper than this years I bet
