can i get a disciplinary for this?

Depends on what is going on.
I've had 12 months of hell with an idiot sitting next to me that has also affected the whole team (and all the people in the building, around 100) but our concerns fell on deaf ears.
It was only in January I ended up having a breakdown, they took it serious so put him on a capability study and he goes on June 1st.
You would have thought he would have pulled his finger out but he got worse for his study:
eg a job that took me 90 minutes took him 3 days, a very simple job that takes 1 minute took him 80 minutes and so on.
How does he affect 100 people? - easy, he traps them in the kitchen or printing room by talking about exactly the same thing he has spoken to them every day. It's bad when you see people walk up to the printing room, look in and then turn back until he's not there.
June 1st can't come quick enough.

I do sympathize, but you are always going to get toxic individuals wherever you go in life. You just have to keep out of their way and limit interaction with them to an absolute minimum. Usually this type of person eventually falls on their own sword and is shown the door.
 
In my last company I worked for, there was a round of redundancies so basically we all had to apply for our own jobs.

A guy who I worked with who I had no idea he had issues with me decided it was a good idea to text me saying I had to report to head office. I did not know the number that texted me and it wouldn’t answer so I called into HR at the head office to report it. They said it had not come from them and they investigated it and found it had come from this guy.

He ended up getting a final written warning.

I’ve also sat in on a disciplinary for a colleague who was going around customers with a broken trouser zip. A customer complained he had exposed himself to her.

Also heard of an engineer visiting a childrens charity to fix a colour printer, used a porn photo to print out to test it.

And the engineer who thought it was a good idea to pickup a very strong magnet and attach it to the side of a server case just after someone had spent a couple of days building it. He got fired straight away.

I'm working with a guy who sounds just like that. When I stand up from my desk he looks around to see which direction I'm going in. If I go into the kitchen, he will follow me there. A short conversation doesn't exist with him and involves him droning on about the same thing everytime. I've done some statistics and he's the worst performer on our team, so going to pass that on during the appraisal feedback in the summer.

Even after 12 months he was calling me his mentor and Senior colleague but he hasn't been in for the last 3 days, I finish tomorrow so will probably not see him - RESULT.

This is the problem, he isn't toxic and he probably has no idea what a mess he has caused.
I honestly believe he is on the spectrum because the things he says and does, equates to the children that my wife works with.
He has now proved that he isn't even incompetent, he goes far beyond that.
He also doesn't realise that everybody he traps in the kitchen/printing room tell us what he's been saying/claiming with corkers being that he was a Barrister, Lawyer, Solicitor, teacher, policeman and so on.
From having no kids he now has 3 daughters.

In a nutshell I'll type what I told HR and used an analogy hopefully they would understand even though it's a different business:

Imagine you are on an assembly line and you have 100 products to complete a day. He comes in and only ever completes from 10 to 20 a day with everybody else having to help him reach 100 but he is the one that goes home sweating. That is not the main problem though, every day he comes in you have to tell him what to do because he's forgot. I'm not kidding, he can't remember a thing so you constantly have to repeat the job to him. When he goes to the toilet he can take anywhere up to 30 minutes because he gets talking to somebody, while he's on the production line he turns round and starts talking to the women on sub assembly and forgets what he's supposed to be doing.

HR looked at me as though I was exaggerating but after his capability study they realised I wasn't joking.

Clearly this guy took advice from people on this forum! And the guy watching for someone to go into the kitchen and following them in was clearly after sex!
