Can I return an opened XBox?

where did you get it from?Try looking online at their returns policy.
Some places(such as argos) offer a 28 day money back guarantee.

Tell 'em it intermittently red rings and you have read about the problem online and lost confidence and want your money back. It's quite a common problem so you may get lucky.

Not a chance unless whoever serves you is dense or they have some form of dissatisfaction refund policy.

When you purchase goods you have a legal right for a refund if the item is returned within 28 days in 'as new condition'. This means that the products you purchased are in a state which will allow the shop you take them back to to be able to sell them off to another customer, if youve opened it then the shop wont be able to take it back and sell it on as a new product, so they probably wont take it.

You could try this, but a lot of places have clicked onto people pulling this trick now and will insist on testing the product. We always insist on testing good before exchanges are given now due to people trying to take the biscuit doing this sort of stunt, and to be honest once youve worked in retail for a while you can spot the honest people from the liars very easily.

Why do I have to keep it if I'm not impressed by it? How could I have done anything different except buy it and try it?

Whilst not trying to sound off hand, im sure you have friends that have consoles so im sure you could have picked up the phone and asked if you could have had a quick blast on one before you buy one.

The trouble you have with returning a console after using it just because you didn't like it is a difficult one. There's not really any valid reasons you can come up with to explain why you don't want it. If you don't like the games, you shouldn't have bought it. Can't afford to pay for it... tough, shouldn't have bought it.

The main issue is that it looks a lot like you rented the console, but didn't have to pay a rental fee for it. Now, if they allowed everyone to return consoles, what's to stop other people who can't afford one doing it when they have some mates around?

Infact, ten years ago now, I had a summer job in Game. I remember they had a used Playstation for sale, completed with multitap and four controllers; this was back when they first started doing trade-ins. A bunch of lads did just this, by buying it and using it for the weekend before returning it for a refund.

In this case, as it was already a used machine the Manager gave them a refund, but told them they weren't to come back to the shop again.

Should have bought it online then you could have returned it under the DSR 2000. Would have had too take the returns postage hit but thats better than having £100+ toy you don't want :p

Cheers Guys, I know I came off a bit hot headed in the original post, was just a bit miffed is all. Like I said where I work someone can buy a computer, fill the HDD etc. and bring it back 14 days later for a full no questions asked refund.

It's no big deal I guess if I can't return it. I may end up liking the game/console who knows. I've seen some software called Connect 360 which looks like it might be better than using MCE. And I have tried media browser but it sadly crashes when opening folders with all my videos in.

I would use XBMC but I don't want to void my warranty just yet.

How long are you leaving it? If its loading in a couple of hunderd of GB of things then it might appear to have crashed but might jsut be taking its sweet ass time, ifyouve only gave ita minute or so then turning it off try leaving it on and just letting it run for a while to make sure its not just taking ages to load all of your content.

It has 72Gb of videos in the folder, last time I left it for about 20 minutes, came back and the screen had gone blank but the console was still running and connected as the extender, it might be some videos in there, they are MKVs but it really struggles.

I don't think the 360 natively supports MKV's yet does it?
