Can I return the HD2900XT if it's not silent?

Was just curious that the HD2900XT is being advertised as Silent in the Title, if it is not silent, then am I in my rights to return it, due to false advertising, also everyone's definition of Silent is different, some people think a Seagate 7200.10 is silent, while to me the motor noise from it sounds like a jet engine..., so why is this card being advertised as Silent in the Title, as I doubt it is quieter than a Zalman VF900 at 5v which is just about tolerable to my ears.., sounds like a marketing gimmick to me...

I can't see it happening some how. Its kind of a well known fact that the fans on the XT's sound like Motorboat when it spins up.

Assuming you buy it from a distance, i.e online and not in person. You have seven days to return it for a refund under distance selling regs. You'll have to pay the postage for the return, but the original postage should be refunded.

But how will he know if its loud? Loud = used = no return.
Distance regs let you open the package and use the item. Software is excluded btw.

"3.58 Can I insist that consumers who cancel an order within the cancellation period return the goods as new or in their original packaging?

No. Consumers are under a duty to take reasonable care of the goods while in their possession as discussed in paragraph 3.44. The DSRs allow consumers to examine goods they have ordered as they would in a shop. If that requires opening the packaging and trying out the goods then they have not breached their duty to take reasonable care of the goods. In these circumstances you cannot insist that consumers return the goods as new or in their original packaging. You may ask consumers to return goods with the original packaging, but you cannot insist on this."

Now that is loud, click for a download.

Correct. Unless it's a media like tapes, CDs, DVDs etc. which can be copied, you're allowed to return an opened/used item. If you're outside the cooling off period though, you're screwed because something being loud isn't a fault.

That said, I think it's fair to say that you should've bought an 8800 Series card in the first place if a silent cooler was such a high priority, and to be honest you only have yourself to blame for that because you don't have to go far to find out which one's louder.

DSR aside - the goods must be as described or they will fall foul of the Sale of Goods Act (as amended blah...) I don't think it would be beyond the wit of man to argue that the hd 2900s are anything but silent, hence not as described - and possibly - Not Fit for Purpose.

Who said I bought it? ,assumption is the mother of all....., well you know the rest, was just curious as why advertise the itme being SILENT which in fact by your replies it isn't, lame marketing attepmt?, OCUK should be ashamed of themselves and it could work against them..

Anyway was thining about a GTX with HR03 PLus & No fan, would have got it to work except can't really find a satisfactory cpu cooling solution for my Silverstone SG03., another thing that gets me, Core2duo's are not energy efficient.., mine is idling at 55 degrees right now, and hits 76 at load using a Zalman 8700 at 5V....

Anyway back to the drawing board..

Same as OCZ claim Silent for their PSU's and the one I had was loud as hell esp 2x80mm fans and ramped up with little heat, Silentpreview wont even entertain them

It says it has a silent heatpipe.....(It's not saying anythng about them having a silent fan ;) )

Yes that really is clever wording, they could claim the whole card is TOTALLY SILENT* then in tiny print on the bottom of the box *except the very noisy fans :D

OcUK could easily argue they are silent at 2D which they are therefore it would not really be false advertising :p

That's due to the fact that the Zalman is at 5v,and also that Zalmans are not brilliant coolers...they work ok/well when at full speed, but other than that you may aswell used stock at half speed.
