Can I return the HD2900XT if it's not silent?

Got one. ;) But I also like my main rig to be quiet. :)

OT:

Ulf I notice in your sig it says you have a 680i, What happened to your P5B DLX, it's been that long since I talked to you properly I feel out the loop  :p

If you have had it under 7days, send back under "distant selling act", reason you simply aint happy with it, you get full refund of original cost, you lose the original postage cost and need cover the postage cost of returning it.

If it was faulty, you would get all the postage back from and to them.

OcUK finally got round to sending me the replacement I was due from February, so I tested it and it worked fine. Decided to keep it and sold my P5B to a mate. :)

tbh, my pc creates around 27dB idle, its pretty loud, but ive got 6x120mm, 1x180mm (psu), dominator memory cooler and the dreaded nvidia 680i NB fan (loud as hell), and it sounds no where near as loud as that, stupid tbh, as a GTX will push out more power and be a lot quiter :S (also i have my case side off 90% of the time)

same, everone of my fans (apart from ram and NB) are running off the power supply, when i first built this rig, i wanted silence, hense the watercool, but its rele not with this type of pc. hard to avoid it rele.

They're 'supposed' to refund the original cost of postage, even if you're just unhappy with it. If you ever get it is another matter.

Office of Fair Trading Link

What specifically do I have to refund to the consumer if
they cancel?

3.48 The DSRs require you to refund any money paid by or on behalf of
the consumer in relation to the contract to the person who made the
payment. This means the full price of the goods, or deposit or pre-
payment made, including the cost of delivery. The essence of
distance selling is that consumers buy from home and receive goods
at home. In these circumstances, almost every case of home
shopping will involve delivery of the goods ordered and so delivery
forms an essential part of the contract

Thats not what Empire Direct told me, I got total refund on my 52" LCD + postage and they picked it up with same courier than DEL'd it. (faulty with known issues)

Why should a store lose out of postage if you dont like the colour of something, AFAIK you lose the postage.

Its same for QVC, you get refund upto 30days but lose original postage.

And you believe what they say over the OFT? Under DSR postage is supposed to be refunded, written intention to return must be within 7 days. They can charge you the cost of recovery if you don't send it back yourself, in the T&C it should say they can offset pickup costs against the original postage if they arrange pickup. The DSRs are separate to the standard sale of goods act for faulty goods.

Don't take my word for it, I posted you the link to the DTi guidelines for retailers. I've had the same info from trading standards, enforcing it is a different issue. The OFT interprets the rules and you don't get much more official than that lot. It's hardly surprising companies bend the regs, last time I looked 50% were non-compliant.

As for sending it back because you don't like the colour, that's the whole point, you can't SEE it until you have it in your hand. And that's why you shouldn't have to pay postage, its supposed to facilitate a fair shopping experience similar to buying the item directly from the shop. Distance buying puts you at a disadvantage where goods may not be of satisfactory quality or as described in an advert. As for costs the reasoning is: If you buy direct from a shop you do not expect the shop to pay for your trip to take something back, so you must pay return costs. However the original contract includes the delivery, if the product isn't what you expect, then the full sum of the null contract is refundable.

OcUK are good example of a DSR T&C

To exercise your right of cancellation, you must give written notice to Overclockers UK by letter, fax or WebNote giving details of the goods ordered and date received. Notification by phone is not acceptable. If you exercise your right of cancellation under the Distance Selling Regulations (2000) after the goods have been delivered to you, you will be responsible for returning the goods to Overclockers UK at your own cost. The Distance Selling Regulations (2000) places a duty on you to take reasonable care of the goods once you have exercised your right to cancel. Returned items must be packaged properly and shipped in a plain outer box. Please try to include all internal packaging, cables, manuals, drivers and protective bags, however small. Overclockers UK will refund you within 30 days for any sum that has been paid by you or debited from your credit or debit card for the goods. If after exercising your right under the Distance Selling Regulations (2000) you do not return the goods as required, Overclockers UK may charge you a sum not exceeding the direct costs of recovering the goods. When exercising your right to cancel under the Distance Selling Regulations (2000) please return goods to Overclockers UK (Esnet Ltd), Unit 40 Imex Business Park, Ormonde Street, Fenton, Stoke-on-Trent ST4 3NP.
