Charged for canceled order??

I recently ordered some goods totalling £108 (inc VAT & Shipping) - now before the goods had been shipped, i rang to cancel the order, however the company is saying that i might have to pay a charge for cancelling??

Can this be right, is it allowed? Surely its not my fault they charged my card before shipping the goods and need to refund it to my card??
 
No, they manufacture the goods and always carry stock as its a standard item.

The simple fact is they charged my card before shipping, i cancel and now they wanna charge me to refund :confused:
 
Yes but conversely its not their fault you cancelled the order either?

It costs them to refund you because they will have ordered things and they usually have to pay to transfer the money back to your bank (handling charges to another company who handles bank transfers).

I guess they debit your card first to pay for the products you have ordered and so that they are not operating at a loss until the product is ready to ship.

I can't say that I agree with it but its just the way things are nowadays.
 
Yes, but their view is probably why should they speculate on whether or not you may actually buy something just because you have ordered it? They either have to order in what you have ordered or pay people to move it and get it ready to be dispatched. With the amount of cancellations that take place companies would take massive hits if they always waited without fail until an order was dispatched before debiting the card.

I'm not trying to have a go, or saying I agree with it. Its just the way most organisations work these days. Although that mainly applies to companies like ticket suppliers...

Check the terms and conditions of use on their web site, if it doesn't mention anything about them reserving the right to rip you off then speak to your card issuer and dispute the debit. I hate dealing with companies that charge your card before actually dispatching the goods (then it normally entails a lengthy wait before they bother dispatching anything), there are plenty of companies who don't do it so I fail to see why others can't follow suit.
 
Was it over the internet, in which case you have a 7 working days cooling down period where your allowed to cancle or return item as long as it hasn't be used. Then can only charge for postage.

Distance Selling Regulations give protection to consumers who shop by phone, mail order, via the Internet or digital TV: The protection includes:

* The right to receive clear information about goods and services before deciding to buy;
* Confirmation of this information in writing;
* A cooling off period of seven working days in which the consumer can withdraw from the contract;
* Protection from credit card fraud.

Yes it was over the net i ordered it, and i guess they cant charge me postage as its not been posted...hence no charges should be incurred :)

Email them, or phone them quote the act and demand repayment.

Also i fubard its only 7 working days not 14

Just for reference, .... not just the internet. It's distance selling generally, like catalog buying, etc. And even the ability to charge for postage depends on tge company having made clear, in advance, that they will do so (though any sensible company has certainly done so by now).

But also just for reference, the DSR doesn't cover all purchases. There are types of goods that aren't covered, or that have limitations on the right to cancel, and it's a bit less clear-cut for services, too.

i cancelled an order on a part from BMW a few months ago, they tried to charge me 25%. after a few choice words they decided to refund the lot!
