Claim for Broken Femur...

About three years ago I was rammed by an idiot girlie who had just passed her test, was late for work, was spotted by a witness applying make-up seconds before the crash, and hit me at 50mph while I was static waiting to pull onto the motorway. She got done for driving without due care and attention and I got whiplash and concussion.

Compensation offer was originally £900 so I refused that amount and they bumped it up to £2400. Never accept the first offer.

Christmas and new year in hospital :( I feel for you mate. I hope you get all this sorted and you're compensated fairly.

Makes me feel bloody lucky reading through some of these stories.

a mate of mine was cycling to work in bristol when a car pulled over in front of him to let someone out from the passenger side. the guy in the passenger seat didn't look before he opened the door, opened it and my mate ploughed straight into the corner of the door.

it hit him in the neck, missed his jugular by mm and lead to him having emergency surgery and a few days in hospital. he came out with around £20k in end, after as eddiemcgarrigle said, he didn't accept the first offer.

OMG, was there a reason for the attack? Pretty strong if there wasnt
He actually knew both of his attackers (friends of a friend) - they were in his house at the time when one of them convinced the other they should do him over and nick his stuff - so when he was sat at his PC one of them walked behind him with a kitchen knife and...........

Jeez, sounds like he's lucky to be alive! Did the buggers that did that get caught?
He is. He eventually disarmed his attacker after a struggle with both of them(hence the wounds to his hand and during the course of it, had his teeth knocked out), grabbed the knife and stuck it in the first guy's chest. The second one ran away.

He woke up in hospital with the attacker lying in the bed next to him. The police thought they'd both been attacked in the house by an unknown assailant - which was soon rectified. They nicked the kid in hospital, who grassed on his mate, who then grassed on him, sending them both down. I believe the main assailant has just recently been released - the other got out a year or two ago.

my uncle had a head on collision whilst driving an oil tanker, into another HGV

His life was cars - he was on the bridgestone formula 2 team as a lead designer for tyres, owned sports cars etc

couldn't drive after the accident for 2 years
i believe he got around £275,000

The amount of damages for your injury can't be valued at this stage because the prognosis is uncertain.

Given your relatively young age, the prognosis is more favourable however.

As a very very basic rule of thumb, if your injury resolves fairly swiftly and leaves no permanent damage, then you are looking at between £3500 and £5000.

I am glad your family are okay and best of luck with your recovery.

Was nearly crushed to death by an idiot driving an uninsured lorry who ran into the back of me at 40mph. Never saw a penny, the guy just vanished.

Look up Kemp and Kemp in any law library under your injury (broken leg ?) and from the latest cases will give you a rough idea (rough but realistic and actually quite close) to what you are possibly going to get.

Back in July 2006 I was in a motorbike accident, car hit the side of the bike meaning my left femur was broken, a 'butterfly' fracture (basically two fractures so a length of bone floating free), so I also have a metal pin from hip to knee,

The claim is still on-going but my solicitor is going to make an offer to the third parties insurance company of £17,000 for the injuries (leg as mentioned, ligament damage to both knee's and some scars on both legs), and a further ~£4300 for the loss of earnings and expenses, which is the care provided by my mum, petrol costs to visit hydrotherapy (had the care/treatment in east sussex but after 3 months I had returned to work so was living in bristol), and the clothes/protective gear I was wearing that day,

It's definately a good idea to make a note of everything, no matter how minor, if you need to get things like bandages/gauze pads for the wounds after you leave hospital then note down the cost, and keep the receipt, then send all of that to your solicitors and you'll get it added to the expenses :)

Dunno if it will help you, but even after the hydrotherapy/physiotherapy was over I still walked with a slight limp and had a bad 'ache' almost constantly in my leg, however I find that as long as I keep going to the gym every couple of weeks and pushing myself on the leg press to keep my thigh fairly strong the ache and limp pretty much disappear...

Shocking, people who end up with serious and streeful injuries get pittance, that **** who posted in motors saying him, his mum and sister all got £2.2k for whiplish when a car bumped into them.

You should be able to get loss of earnings aswell.

A 18 year old boyracer slammed into an old lady in who was waiting to turn right, my wife was in her car in front of the old lady - also waiting to turn right - they were both stationary (the muppet was too busy looking at a girl walking on the pavement to see them waiting to turn right)

He hit the old womans car with enough force to crush it very serverly - & push it into the back of my wifes car, and squash the boot to half its size. Luckily, the headrests stopped the wife breaking her neck - but she got just over £3000 for the continuing neck and back problems shes had for the last 7 years and the 3 weeks off work. Unfortunately, the old woman fared a lot worse and spent many weeks in hospital.

Surfice to say, I lost the head with the muppet, as I was called to the scene and arrived just as the 2 ambulances arrived (and he was walking about smiling as the old lady and my wife were unable to move in their cars)

The money wasn't important - the fact he was procesuted for it made it a lot more bareable.

Hello Dave, not sure of your age or your occupation but these must be taken into account along with the fact of the steel rod in your leg. Is this a temp thing until the bone heals or permanent? If the latter then it may affect what work you can do in the future.

Meanwhile don't forget your entitled to a Blue Badge for parking if walking is painful or causes distress in any way.
No matter what your financial position at the moment I believe you are also entitled to claim DLA [Disability living allowance] Mobility component is Approx £45 per week and high level care component is £41 per week. Both of these are none taxable and payable to you even if your receiving income from other sources.

Pleased to hear that in all other aspects you and your family are OK.

In November 2004 i came off a moped i had! Nearly lost my leg but luckily not and i came away with just a dislodged knee cap, shattered ankle and a "full thickness" burn which is a burn straight down to the bone which has left me with hardly any feeling in my right ankle thanks to no nerves and tendons! 3 months in Odstock burns unit and 3 months recovery at home! The case was settled in April 2007 and i had to take 50/50 responsibility! 13k up and hence the reason my sig suddenly appeared :)
