Does "your friend's" company have stated explicitly in their IT Security Policy/Acceptable Usage policy that they monitor staff? If not there is sod all they can do and if they try and pull him up on it he can point out that they have breached the DPA by failing to notify staff of the monitoring that is in place, the reason for it and the consequences of it.
They will still sack him, they'll just be more creative in how they do it.
He'll probably get the sack although I'm surprised he managed to download it, torrents can't get through the firewall at my work and I'd have thought an ISP would have cracked down on this.
No doubt, but he can then report them to the information commissioners office who take all breaches of the DPA quite seriously and will investigate the company and if found guilty of a breach can fine them or force them to change their business practices.
