Credit card problem - help!

Typically selfish, lack of responsibility, it doesn't matter if my demands impact others attitude. You'd make a good labour voter with thought processes like that.

they make the mistake i charge same as if i make a mistake they charge. the difference is they are in a stronger position to take your money as the bank already has it.

Why would they? They communicated the process clearly to the customer. The customer misinterpreted the clear instructions.

For all the company knows, he might have paid off the grand because he had another big CC purchase to make.

It is not the company's responsibility to assume or second guess the behaviour of their customers, only to manage the terms of the contract, it is the personal responsibility of the customer to check the consequences their behaviour could have.

its not second guessing is it , he paid it off 2 weeks before, the company have no right to take it out again.

The company have whatever rights the OP granted then in the contract, and the quote from the communication from the company is explicit in what those terms are.

We will start collecting your monthly direct debit payments after your next statement, if a payment is due in the meantime please pay by alternative means until your statement advises the next payment will be collected by direct debit. once your direct debit is in place, any extra payments you make will not affect the amount we collect unless you contact us at least five working days before the payment date.

So the company absolutely has right to do that, because that is what the OP has agreed to. Those little things called contracts and the funny pieces of paper called terms and conditions do actually matter you know...

I'm surprised that you are so bad at money management that you get bank charges in the first place...

The point is i dont, i have account for my DD, the mistakes are always the companies not mine, the right amount of money is in the account, and companies always makes the mistakes and the bank charges, how is that my fault why should i pay for there mistakes. So i see it a a form of compensation, for my time.

Use better companies or stop doing strange things with your payments, I've never had any of the large numbers of issues you obviously do with DD, I've never had a company take the wrong amount, or take duplicate payments, or anything similar...

Well then he can try, then again did he get his term and conditions before or after he paid?

Then you have be lucky, ive had 5 in almost 3 years. and its the same oh sorry computer error making out like its not their fault. companies will try to get out of paying you if they make mistakes.

From the posts, before, he just decided that the next statement didn't actually mean the next statement, but the one after, for reasons I can't quite understand.

I'm just careful which companies I use and which I give DD instructions to (Plymouth City Council being the obvious one who will never be allowed anywhere near my bank account because they are known for monumental incompetence).

I've also never had any issues getting suitable compensation from companies when they have made errors, perhaps it is your approach or the sort of company you deal with that leads you to have problems?

The words they (MBNA) used were "after" the next statement.

To me that means :

Statement No 1) - Next statement

Statement No 2) - The statement After the Next statement

To me, 'your payment will be taken after the next statement' means that the next statement delivered will trigger payment x days later as per the normal DD process...

DD payments are always taken after the statement date, so the first payment being taken after your next statement will always mean that IME.

He done what they call an over payment, because he paid before the statement. So they have just taken the normal payment when it was due.

My wife once paid before the statement came because she was away when the normal payment was due,so they charged her non payment fee even though she paid early. They refunded the charges and now we pay all CC with direct debit. But if you read the T&C it will tell you all this but has most people don't you can't moan when you get it wrong, it's down to you to read before you sign.

It makes sense to people who have delt with credit cards in the past but not for a novice from the information in their letter and from the phone call I had when I activated the card when the operator told me to arrange manual payment for the first statement.

Anyhow, thanks for the info, I understand the procedure now and sure as s*** it won't be happening again
