Of course it shouldn't scratch discs!
All the early cases of 360's scratching discs were when people were moving the unit around when it was switched on - such as moving it from standing vertically to horizontal, not wise to do in anything with a tray loading drive!
If it is scratching your discs on it's own accord, call MS or get a replacement from where you bought it.

horizontal xbox, video lead has been ripped out the back, red lights. panic stricken i take out the disc and have a look, there is a 5mm thick scratch all the way around the middle of the data part of the disc. DOH!
