ebay help!

I started a dispute, even though I have tried emailing him several times and phoning him to no avail he has replied to the dispute.

hi i didnt even know that i won the carso i dont know what to do as i bought another car

Now what can or should I do?
 
Basically, there is beggar-all you can do. You will come to a point where you cannot agree. If the Ebay arbitrator finds in your favour (which they will) you will be allowed to leave negative feedback and he will receive an unpaid bidder strike, but other than that, there is nothing you can do.

It's like a bloke coming to your home and agreeing to buy your car. He says he will come back tomorrow with the money. He never comes back. There is nothing you can do I'm afraid.

I thought an ebay bid can considered a legally binding contract and therefore you can sue someone for the money if they dont pay via the small claims court system?

I know he's lying if you can log on to ebay then you know you have won, let alone the emails.

I have thought about small claims court, but I'm having a cash flow problem at the moment and can't really afford to pay the £25...

Grr.

What would you guys do send one back trying to get him to buy it, or ask him to agree not to buy so I can get all my fees back (mutual agreement thing)

oh this is the listing, he can't even say I've been dishonest in the listing.

The mutual agreement thing will get your fees back, but you can't leave him feedback or give him a non-paying bidder strike. If you leave it to the arbitrator, it will take 7 days but you will get your fees back (you don't have to pay them for 28 days anyway) and you can give him the -ve feedback and he'll get the NPB strike.

It's a pain, but you're stuck unless you can convince him to pay up. I know it doesn't help now, but for future reference, I always check out my bidders before I accept their offers simply because I got stung like this myself. This guy isn't a very good ebayer - is he? 47 transactions, 33 feedback, 2 -ve feedback (one buyer and one seller) and 3 neutral feedback. I would say he's about to be 'No longer a registered user' with your complaint. You might want to mention that to him, it might encourage him to pay up.
 
a couple of negatives I don't mind most people get 1 or 2. But yeah i see your point.

I really fancy doing small claims court just for the experience LOL. Would I deff win..

Whenever this happens I get the usual pattern:

No contact - Non Paying Bidder Alert - Fees returned - Negative feedback - they leave me negative feedback with a bull story and then just move on.

Sadly, you would almost certainly lose. You would definitely lose if he turned up, took one look at the car and said 'No thanks'. You could sue for breach of contract or breach of promise, but you can't do that in small claims court as you actually have to have suffered a financial loss that you can use small claims to recover. Ebay will refund all your fees if you relist and sell again so you actually will suffer no financial loss as a result of his (in)actions.

I would work on the Ebay folks to get him booted, to be honest. It's not that financially rewarding, but you'll be doing his next potential victim a good service.
 
Personally if it were me Id just be after the fees back. Email *** buyer, explain you wish to get the fees back and you require his cooperation. File a non paying bidder, he agrees, you get fees back. Sorted, then relist.

That's odd - I've had 2 non-paying bidders and neither could leave me visible negative feedback once the non-paying bidder strike had been made against them. One of them was a complete bandit and had convinced someone to send him £500 worth of computer gear 'on approval' - he then said it was lost in the post and didn't pay. He was banned pretty rapidly after that.

You'd laugh that someone would fall for that trick, but for the fact that it's almost certainly someone who can't afford to get ripped off that was ripped off.

Ebay is set up to allow people to stay on Ebay for as long as possible and make Ebay as much money as possible. Even if they are bad Ebayers. I much prefer to sell my stuff on Member's Market, although the prices are significantly lower.

OK - That's a valid point of view, but you have to wait 7 days to file the non-paying bidder alert. That's 7 days when you can't sell the item in question. Then you have to wait a further 7 days for ebay to allow you the fees back. That's 14 days when you can't sell the item because the original bidder might still come through. And then you have to work out whether to contact the next highest bidder and offer him a second chance or just to relist and have another auction. Add in the original 7 days for the non-paying auction and now you've waited anything upto 1 month to sell something. That sucks big time.

And the guy in AcidHellz case is a serial non-payer. He's done this before. That's naughty and has to be stopped, surely?
