Ebay issues - Need some advice

I sold an iPhone on Ebay last tuesday. I contacted the buyer and explained that I wouldn't be able to send it until thursday and he accepted that. So, I got it in the post on thursday morning, at 9.58am, according to the receipt. I expected it to be delivered on Friday, but it wasn't.

Saturday comes, and it still hasn't been delivered. The rather annoyed buyer contacts me, saying that he wants a refund as it was meant for a birthday present, and before I get chance to reply, I notice that he has disputed the payment on PayPal.

Despite me providing the tracking number, on Sunday, Paypal issued him a refund. I had already transferred the money into my bank account, so now I am almost £200 in debt on my paypal account.

Today, Monday. On a slightly related note, I sold a Nintendo DS on MM. I posted it at exactly the same time, with the same delivery method (1st Class Recorded) - That arrived today. The iPhone has not been delivered.

I contacted the buyer and politely requested for him to return the phone when it arrives due to him already getting a refund. I even offered to refund postage posts, and he replied with a rather hostile message, saying that it is Royal Mail's problem, not his. I replied and mentioned that I would involve the police if he refused to return the phone, to which he replied "it not my problem as i didnt recived the iphone so it is royail mail problem go and contact them you should contact FBI not police go a head and do it what you waiting for?"

I've contacted Royal Mail today, but they were less than helpful. I've also contacted eBay and PayPal, and have basically been told that I should try and resolve it with the buyer.

So, what should my next move be? Considering that the iPhone hasn't been delivered, I am thinking this is something for Royal Mail to figure out. I am inclined to goto the police with this, and for all I know, the package could have been stolen - Even more reason to involve the police.

Sorry for the wall of text. I'm just really annoyed right now.

you sent it recorded is there a signature? if not you claim on RM insurance for the item... (speak to them I assume they will investigate and give you a claim form)

So you sent an item worth £200 by recorded instead of Special delivery. Buyer probably received the phone and is keeping it along with having his money back.

You either claim £41 or whatever it is from Royal Mail and sort your paypal balance out and take the hit on the chin or forget the paypal account and get ready for letters through the post from paypal.

Tracking says "Item AI831290052GB was posted at 5 The Parade BS11 9TS on 02/02/12 and is being progressed through our network for delivery."

I know it was stupid of me to send it recorded instead of special.

I've sent plenty of items that have been delivered, but still have that message. Silly, really.

With 1st Class Recorded, you know that the item hasn't been delivered? Maybe the buyer has just been carded and isn't bothering to pick it up from the depo? If it remains uncollected, won't Royal Mail return it to you after a while?

The other option is that is has just been lost/stolen on route in which case the correct thing to do is to claim on the insurance - unfortunately, it doesn't look like you insured it for enough which was rather silly.

So have I. I've also received loads or parcels even large parcels by recorded delivery that RM did not even bother getting a signature for, hence why I think there's a possibility that the buyer has received it already.

buyer has recieved it pocketed it and got a refund, sadly you loose.

Suck it up and remember this is why you should never sell electonics to wide boys on the bay.

Sorry to hear about this, crazy indeed and Paypal seem to just side with a person disputing without even requesting a tracking number from the seller?

KERAZEEEEEEEEEEEEEEEEEEZZ!!!!

I don't understand why you would send a £200 item insured for only ~£46, Special Delivery could have avoided all of this.

Royal Mail probably have a division that check all uninsured items sent by mugs and intentionally 'lose' the expensive ones, £154 profit in this case!
