Enforcing a CCJ - Bailiffs or Sheriffs ?

You guys are quick to assume the £950 payment was a bad move. If this is a £10k wardrobe (which it could be if it was bespoke and fitted etc) then £950 isn't a bad option rather than losing the full £10k.

An excellent point, but the OP states he paid in cash on the day he bought it.

If the wardrobe was worth £10k (or any amount which makes £950 seem insignificant) then that was one of the stupidest things I've heard anyone do! Especially considering it's a "one man band".

I'd feel uneasy paying that much upfront for a large business, nevermind Wardrobes R Us
 
You bought storage and then paid extra for storage?

Did you buy the wardrobe from him or a business, if it was him it's a private sale and I don't think you can do anything, if it was a company and it's bankrupt (or so he says) you still probably can't do anything.

Check the status of where you bought it from then go to the courts, I think you have to go to the county court first then high court.

Ignoring everyone calling you whatever, go up, use the higher level, enforce it, see what they can do, as you paid him personally, they can go to his house and take his stuff. Its not in a company name the CCJ, so just do him, get them round his house, they can enter, they can take his home stuff to sell at auction to recover your fee, iirc it doesn't cost much of your 950.

Do him.

I'd do this, if you've already got a CCJ in his name then get your revenge, high court sheriffs, no nonsense, they can turn up and just take his things to cover the costs.
 
Upon reflection:

I bought a wardrobe from a small shop in london (one man band), I paid in cash on the day.

I then chased the guy for delivery for ages

and finally I had to arrange my own collection a full 10 months later,

he then forced me to pay £950 to his personal bank account to cover "storage".

I had not choice as he said he has bankrupted his company and now training out of a new company.

So I paid up and took him to court, I now have a CCJ against him

Now I have a choice, I can bounce it up to a High Court Enforcement Officers, HCEO or just get a normal Bailiff.

Is it worth the time and effort to move it up to the high court? Any feedback would be welcome. He is polish and I know he has assets in Poland also.

As someone who spends huge amounts on cars and a house, why on earth are you asking us how best to legally punish someone because you made very poor decisions?
 
Right, sorry been out all evening and just got home :)

So regarding the wardrobe. The shop is in a expensive location in central london and has been there for a long time, I paid around 1/4 of its retail cost which was still a lot of money but its quite big and very good quality.

The owner of the shop is a complete joker, I contact the manufacture to ask about some extra parts and it turned out that he has not paid them 40k Euros for the stuff he ordered inc this wardrobe.

I don't have any photos of it I as I moved out of the house some time back but its something like this with a mirrored doors

Anyway thanks for the info, I will put in for the high court judgment and see how I get along. I think it will take the best part of 5 weeks to get the high court judgment. I have had CCJ's against people in the past but they have all paid up I have never had to go through any enforcement process before.

out of curiosity if the manufactures take action could they come for the wardrobe?


kinda a selling/receiving stolen goods thing
 
Just get it to the HCEO's, send them to his shop and you're done. As long as the "new" business is in his name, they'll take what they need on the day.
