Eviction of people not on tenancy agreement?

I think some courts can be anal about doing everything to the book, assuming this ends up going to court.

Why would it go to court? The other person has zero legal rights to be there. In this instance the police would just remove the person.

If the person kept coming back and harassing OPs sister, then you'd have to go down the route of a restraining order.
 
I'm surprised that we haven't had the proper GD response to this thread yet, which is for the renting family member to poo in their own letterbox. This should make the freeloader (ex)boyfriend finally leave then the poo can be cleaned up :-)
 
The law might have changed but written or not, a tenant has default rights. Even with no paper signed at all there is law covering the terms of a tenant, this would happen for example if an agreement lapsed in its term
 
Sounds like an ex boyfriend who used to "stay over quite often" and who now has unauthorised access to her property. Call non emergency police when he's in earshot.

They're not legally a tenant though. Simplest solution is to politely ask them to leave, and if they refuse then wait until they're out and have the locks changed. If they start getting arsey you phone the police.

From my understanding of the OP they at one point had a right to be living there, (they informed the landlord and they were okay with it).

While that right may now be rescinded I don’t think you can just throw a person on the street without “due process”.

Obviously they don’t have the full right but showing the courts you have given them notice before taking action won’t hinder any case brought against you. If a case was brought against you.

Perhaps one our resident Ronnie Pickering-esque hard-men could stop by to offer their advice as to how to address the situation with the ex? Provided they’re not standing in an aisle at their nearest Pets at Home, screaming at the Chinchillas with their shirt off of course.
 
If they're not on the tenancy agreement, they don't have a legal right to be there.

If they're paying rent then it's illegal subletting and both of them could be evicted.

Not necessarily, you can be the main tenant and sublet to say either subtenant (s) or lodger(s) with the permission of the landlord for example.

When I first moved to London I rented a room in a townhouse in Islington, the tenancy agreement was in the name of one person and they sublet to myself and the other two people living there, I did have to contact the landlord for stuff on occasion but I had no formal agreement with him.

When I moved on I was one of three official tenants in my next place (a flat) and we sublet the box room, that was a bit dodgier as it was more informal and probably did break the lease, the landlord knew but didn't care.

It's a good way of subsidising your own rent when saving for a deposit, especially if willing to take on the risk of having short-term subtenants in. Some people take it a step further and contract with multiple landlords to rent properties they don't even intend to live in and then sublet all the rooms, that seems like a lot of hassle and a silly risk to take on.

Yes the landlord is aware they are there. No this person pays 0% contribution.

I'd be tempted to say risk it and kick them out/change the locks then:

If the tenancy agreement is in your partner’s name, they could ask you to leave and you might not have much time to find somewhere else to live. If you’re in this situation, talk to an advice charity or get legal advice.

If they've not been paying rent or bills then it doesn't seem like they'd have a very good argument that they're any form of tenant.
 
If theres no tenancy agreement then they're a lodger and have no legal status. TA is to protect tenants not landlords, without a TA they don't have a leg to stand on.

Lodgers can have some rights including being given reasonable notice or notice equivalent to the rent period, it's not just anyone who isn't a tenant AFAIK.


Someone who doesn't even pay rent is perhaps more just a guest in the property.
 
Thank you all for your inputs. I have had a sit down today with my sister to discuss the best options. For clarity. This person her ex girlfriend.

What the current plan looks like is that she will be staying with our parents due to it's location near her work until the third of Jan of which she has told, written a letter to along with an email informing said ex girlfriend she is expected to be gone by the time she returns on the 3rd. The house will be thoroughly photographed and all items remaining documented before she leaves and the cameras around the house will remain active (my sister has a young child as such has cameras around the house to keep an eye on her whilst she is in other rooms doing things such as cooking) And this fortunately has a 48hr dvr connected to it which regularly uploads. So evidence from inside and outside of the house are all covered should ex partner decide to do anything unsavory. The landlord has been informed and is aware of the situation and knows said person will be moving out and has agreed as such to allow me to change the locks which will be done upon our arrival on the third.

Said ex girlfriend just slobs on the sofa all day playing fifa. As an incentive for her to move i am about to phone the internet company and kindly ask if it is at all possible to freeze the connection for a few days so she will bored enough to hopefully pack her bags.

The internet as with everything else is in my sisters name so i don't see this being a legal problem.

From my side i simply can't understand why she would want to stay anyway? Doesn't have any form of relationship with my sister. Doesn't have anything to do with the kid. Doesn't Contribute in anyway. Has a partner elsewhere. Has family scattered around the local area. From what i can gather she is just doing it to be a pain in the bottom which she almost always has been.

Anyway hope everyone else is having a great holiday :D.

Go the whole hog, get an electrician to pulled the 100A main fuse on the electrics.
 
Was going to say if it was not for running the cameras I would be switching of all electric and heating and taking photos and tell her to get out now to a hotel your not here to pay for her freeloading. She sounds like a total parasite.

She is a parasite however we have decided it's best to do it this way simply because of the child. We don't want any sort of reactions going on around her so she has been given these few days to pack up and leave. Kiddo will be staying with her grandparents along with my sister but will stay a couple days longer for a "sleepover week"
