Faulty in first 6months, returning/exchanging.

Whats the law regarding the above?

I bought a netbook in January and the touchpad has stopped working, can I return to selling (No competitor hints!) to be exchanged. Or would I need to return to asus?

Only problem is I cant remember if I ever got round to registering it for warranty :o

Currently all documents/box is at home, and Iam at uni so looking for advice/exploring options before I shift through all that!
 
Faults within the first 6 months are deemed to have been present at point of sale and therefore automatically constitute goods not of satisfactory quality. The onus is on the seller to prove that the goods were not faulty. Return the goods to the seller and you are entitled to repair, replacement or refund.

I've never used the marketplace, but are we talking an affliate company that sells on there or is it 2nd hand?

If it's 2nd hand then you're screwed legally I think.

OP: I've never filled out warranty registration stuff and used proof of purchase if I ever had to send it back to the manufacturer, so I wouldn't worry about that although it's a good idea to fill that stuff out anyway. I just always forget >.<

Was it brand new?
 
Yup, it was brand new. And as far as I can remember it's a company that trades through them.
Also, doubt it would matter, but the sticker underneath the netbook has rubbed off/burned off due to heat.
So can't read the IMEI number or what ever it's called.


I really should re-read the rules, as I notice poeple naming high street stores that also sell computer stuff.
 
Oh, I see. To be honest, whoever filtered out the "competition links", I think you went a bit OTT clearing out a classified ads site. What's next, blocking "the newspaper" as it's a medium for buying things? :pYou need to return it to the people who you have the contract of sale with.
It's not a classified ads site, it's one of the biggest internet retailers going, that happens to also offer 3rd party companies/individuals an area to sell their products.

Your normally all right to speak about companies such as the one above as long as it's not about their computer products, or their major product area is the same as OcUK.

but as said, being a getting daddy on the case- just to make me sound like a spoilt brat :P
 
I always avoid quoting legislation or name-dropping acts in early communications. I would simply tell them that you bought a product on X date and it is no longer working in Y way.

They should take it from there.

EDIT: I'd recommend doing it yourself. Not understanding your rights as a consumer, employee, person etc. is a sure-fire way to get trodden all over :)

think I could push for a refund? (edit) As the duffed touchpad is a common fault these days.

And i was also thinking, going in all guns blazing is the wrong tactic, doing customer service myself i also go "meh, they aren't being nice, I wont be nice to them!"

If i could get a refund, any suggestions for a new netbook/13inch thing? Roughly the same price, just the screen resolution annoys me, having to scroll sideways at times.

You can request a refund, but the seller is within their rights to offer you a repair or replacement if the cost of a refund would be disproportionate to repairing or replacing it.
