ffs

My dad was recently attacked in a similar fashion, the police said they couldn't do anything except tell the attacker to behave himself as it was his first offence. Same with the second offence, only third time can anything be done.

So basically you have free reign to assault someone you dont like apparently. :)

Utter rubbish.

Are you saying the law is rubbish, or what I've said?

We have had lengthy discussions with the police about it. The only possible action is to do a civil court case, which isn't worth the effort. So no, not "utter rubbish".

What you said in your original post.

Since when has assault been a civil matter !

yay for british laws / taxes screwing over the people that abide to them :(

Sounds like the police just couldn't be bothered taking it further to me.

If someone assaults you, it is ALWAYS a criminal matter - first offence or no. Assault is against the law. Full stop.

Your dad should have pushed it further.

It isn't.

If you have no criminal record, you can assault someone with no penalty. You cannot take them to a criminal court.

You are wrong. I have no criminal record, I go outside now and punch someone on the face, I could be cautioned, yes, but I could also find myself up in front of the Magistrate.

You have an axe to grind and your post are not a true reflection.

How does that work?, I've been involved in a similar incident and charges were pressed (ABH iirc). When a person is assaulted in a clear cut fashion (as is the case here according to the OP) the police should, and usually will arrest and push for prosecution. It makes no difference whether a person has prior convictions or not. A crime has been committed. /end

And with that attitude they do get away with it. Caution or not if no-one reports it how do they get a first offence, let alone a third?

updated first post.

him and his house mate are going down there later to speak with the manager & get police involved etc
