Google employees charged over videos posted online - wtf

While I agree with what you've just said, surely without the camera the video would never be able to be uploaded in the first place... and I wasn't being too serious, more trying to point out the absurdity of the judgement.

I don't think the judgement is absurd though, just ill-thought out. Practicality should triumph over the letter of the law in a case like this, as people are saying, google do their level best to ensure offending content is removed asap, and that is about the most they can do while still providing the service as is. this case should never have happened, if Italy wants their laws to work like that they should have warned google to withdraw the app from Italy.
 
It's Italy, the country where the mafia still exist and you can't get anything done without large donations to politicians – did anyone expect a court to make a sane ruling?
 
Another verdict of fail due to someone or some people not understanding modern technology I guess.

The Google folks removed the video once they were aware of it which was 4 hours after it was uploaded as well.

It's as bad as the law where if someone hacks your internet connection, you are blamed for if the person then downloads child porn?

Isn't this basically (for google) like saying that if I break in to your car, steal it and go mowing ver a few dozen people that clearly the car own should go in jail, because you provided the killer the tools to do the running over?

(I admit, I'm some what.... going OTT with this example, but still).

Completely ridiculous - if there was any common sense applied they'd realise this law isn't compatible with the internet generation.
 
I suspect Google will fight this all the way to the highest courts in the EU if need be*, as has been said already if the people who were charged were not directly involved, or indeed even aware of the content in question, how can they be responsible for it?

It would be akin to a forums being held responsible for content someone has posted, without the forum's operators being notified that the content was there, or for a hosting company to be held responsible because someone used a rented server for something illegal.



*Google have a rather large legal team, a lot of money and a vested interest in making sure that their employees (and directors/CEO etc) aren't held responsible for the actions of others, without at least being given the chance to act first.

It's not even compatible with the postal, wireless, or telephonic generations either (all of which have an exemption for if someone misuses the service and the company has no way of monitoring all the use of the service for any illegal activity).

yes, you are :P

again I have to nitpick the analogy same as the video camera one, because all your examples require a criminal act to be committed by them prior to committing the act that lands the 'owner' in trouble.

However, just as you can't reasonably expect someone to buy an ED-101 to protect against any possibility of their car being stolen (unless it is by Robocop), you can't reasonably expect google to watch all the content prior to it being uploaded and still provide the service in any meaningful way...
 
The Italian courts are not known for their sensible rulings, I expect this will be overturned on appeal.

Google obviously done everything humanely possible to remove the offending video as soon as they were made aware of it. That they also helped the authorities in tracing the culprits is also in their favour.

Judgements like this have happened to Weapons manufacturers and Drug Companies etc before and have always either been thrown out or overturned on appeal.
 
That is easy to say but going by wiki, 20 hours of video are uploaded each minute, which is far more than can be humanly checked. Surely if they put warnings in place to say that offensive material is not allowed and they do remove it within hours, should they be blamed?

Would you consider it acceptable if Google were to offer people a platform to put forward whatever offensive or inflammatory views they fancied and Google could then just give a Gallic shrug and say "Nothing to do with us Guv."

So in your world pretty much every web forum, wikipedia etc. would have to either moderate every single post/edit or close down. lol.
 
Judge sounds retarded if you ask me. Google legal team would fight this to the death

Hepefully the judge has now retired/been sacked
