Got the sack.

Why? I have worked for 2 very large and well respected companies in my career and got references from Managers directly.

yes you have less rights as you havent been there a year but you still have rights. ideally you would be a member of a union but i would contact CAB and see what they say. id at the very least be expecting paid notice from them

read your contract carefully , im sure they need to 'prove' gross misconduct or give you notice/warning .

i remember someone saying something about getting a union member to represent you if they try and call you in....something along those lines.

Doesn’t state anything in my contract about gross misconduct from what I can see apart from my OP about a fundamental breach of contract.

Under the header “Disciplinary procedure” though it states:

“The company’s rules and disciplinary procedures are shown in the employee handbook. It is your responsibility to familiarise yourself with these rules and procedures."

and

"During the first 12 months of your continuous service, the company may terminate your employment without recourse, either in full or part, to the disciplinary or appeal procedures"

I didn't get an employee handbook so can only go by my contract and the 3 paragraphs I've quoted are the only 3 I can see about disciplinary and contract terminations.
 
If it was me I'd fight it, but then I will never....ever....take any **** from employers. Seen too many colleagues getting shafted and just taking it. Employers typically do things like they have done to you because they feel that nobody will ever have the time/expense/effort to take them on legally. In most cases, perhaps over 99%, the employee does nothing and just moves on.
 
Fight your corner, but be prepared to go.

As mentioned it's a blessing in disguise. Without being a snob, there is far, far more to life than working in a call centre, and the people you'll leave behind are worse off for it.

I want to and am willing to fight it, but I'm already gone so its not like I can even arrange a disciplinary, I can't even get into work (security fob was taken) so where do I go? I guess I'll go see CAB tomorrow and see what they say, it is just a walk in thing right? No need for an appointment or anything?
 
Hmmm, sounds a bit dodgy to me. What do you have to lose by fighting your corner though?

I got sacked from a call centre due to a customer not understanding what I was trying to explain. That was really it. When they fired me the next day I threw my key card down on the desk, it slid and hit a women manager.

Next think I know I'm banned from working through Adeco or whatever they're called ever again due to be violent towards women. Absolutely ridiculous.
 
Sorry to hear this mate but I will also add my voice to the others who have said it: it is a blessing in disguise. I have also been thru CCH (call center hell) for 6 months and that was it never ever ever again. Hellish job.

Put it behind you and bang on with ur life. I know job market aint exactly rosy but crack on and you will find something.
 
I worked in a ****e call centre once and doing what you did was a cardinal sin... Im surprised you didn't get a warning first but you might be a bit of a **** so who knows? :O
 
You can probably fight it as it appears that they just ran roughshod over the disciplinary procedures. Is it worth it for a part time call centre job? Probably not.

I think they all are, they have a dedicated computer with them all on with speakers so you can listen to your calls in reviews.

So, just write to them asking for the copy?

Phone the agency back and ask for a copy...
 
It wasn't through an agency (sorry If I'm not understanding you right :p), but yeh I might ring them, I know how to get through to individual stations such as supervisors etc and I'll ask them I require a copy of the employee handbook.

I'm hoping in the letter they send it will have a section regarding appeals.
