The rules still state that there must be intent, it's just the way officials determine intent that has changed. If the official believes that the player has put his arm in an unnatural position in order to make himself a bigger target and or to gain an advantage then it will be handball. That was obviously not the case in this instance. In theory your example shouldn't be given as a pen but it wouldn't really be logical for a player to put his arms vertically in the air and an official is more likely to believe he's done it to make himself a bigger target.So it wouldn't be a handball if a player stuck his arms vertically in the air trying to avoid touching a low cross and the ball hit them? the rule seems intended for players falling/slipping not moving your arms to an unnatural position intentionally to subjectively not gain any advantage.
