Grrrr.......clumsy Citylink

If they where so high value,then why where they not very well boxed ??:confused:

This is the annoying bit. They were properly boxed up but the courier delivery guy was having trouble getting them out of the van so he took them out of the boxed so he could carry them easier, and sadly dropped one of them in the process.

I'd just got out of a meeting so he'd already done this by the time I got there to sign for the wheels
 
I dont understand this. If you received the wheel damaged then the delivery should have been refused. The claim procedure should then be up to the seller while you pursue THEM for the product you paid for, it is their responsibility to get the items to you in perfect condition, not yours.

and no way i would settle for refurb.

Who did you buy them off by the way ? if you bought them off a business, Its the companies business to chase up citylink. Not yours

Sales of goods act stipulates it is the sellers responsibility to ensure you get the goods as described. They would have been sold as new, so massively chipped is clearly not new. Contact the seller, and ask for a replacement to be sent

They should then claim from citylink.
 
Exactly, he shouldn't be going near citylink. He should be chasing the garage from where they were purchased for a replacement item. If the garage wish to claim from citilink then that is their prerogative.

Dont bother dealing with citylink, unless you arranged them as the courier, if you bought them new, from a garage, and he decided to use Citylink, you deal with him direct and tell him that the wheel has arrived damaged.
He has a contract to supply you with x amount of wheels in x condition and his choice of courier is part of contract to supply, he has failed to supply those wheels to you as contractually agreed.

Harsh on him, but thats how it works.

This is what you should be doing, the contract for delivery was between the seller/shop and CityLink not you, so contact the seller/shop to let them know what has happened.

Surely any delivery driver would be fired/sacked if they opened a parcel without the owner permission or the owner being there :confused:
