Guy got arrested for making racist comments on twitter about Muamba

He should have used the Chewbacca defense.

It's really painful to have to defend the right of cretins like him, but I strongly believe this is completely out of line.

Indeed - he was a total douchebag for writing what he wrote - Completely ignorant racist - however the punishment, as you said, is completely out of line.

Stupid people have no intentions as they do not think about the consiquences, hence, he is not guilty.

(5)A person who is not shown to have intended to stir up racial hatred is not guilty of an offence under this section if he did not intend his words or behaviour, or the written material, to be, and was not aware that it might be, threatening, abusive or insulting.

He offered a guilty plea, therefore he is guilty.
 
At the end of the day the acts are he used repulsive racist language that was completely inappropriate in a public place, this is illegal, he was found to have committed this crime and has been convicted, the sentencing is hefty but is defined in law to be an acceptable sentence for the crime.

Maybe he is being made a showcase but that happens all the time in the law. And it is good to show that this type of despicable behavior can have severe consequences.

The proof was written all over the twitter account. Not much you can do when yo are guilty and the proof is in black and white.

He obviously couldn't deny posting the comments but surely he could have disputed the 'deliberately inciting racial hatred' charge? He's just another idiotic, drunken student who made comments without considering the impact they may have.

To jail him will certainly teach him a lesson but I think a stint of community service or a fine of some sort would have been more appropriate. The judge had obviously bore witness to the outpouring of public support for Muamba via our 24hr rolling news and bowed down to what he imagined would best appease the public.

As much as I disagree with what he posted, I hope he appeals the jail sentence - and wins.

What the dude did was well wrong but doesn't deserve jail! People get away will much worse!

I agree. The guy would be classed as an internet troll. Sites and forums usually ban trolls after a few warnings have been issued. If it was more extreme / persistent, then perhaps report IP address to the ISP for a suspension or ban from the ISP too. It definitely shouldn't be jail though.
 
If it had been about any other person he wouldn't have got any time at all, its only because Muamba was in the media spotlight after what happened. This guy wasn't the first person to say something racist on twitter (saw loads when the whole Evra/Suarez thing was going on) looks like they're just trying to make an example of him as the media picked up on it.

I don't agree with what he said, but its all gone a bit crazy.
 
His defence must have been really poor, and he got shafted. There is ways to argue around the point.

And now all the self-righteous pr*cks are jumping on the bandwagon. I would have given him some counselling and community service to get his head re-adjusted.

The guy has made totally stupid comments, but I can't help feeling that the punishment is completely over the top. Not only does he stand a chance of a conviction but I've read on another forum that he has been kicked out of university, with only a few weeks left until his graduation. So, a possible conviction + no degree + outstanding student finance (for nothing) and to top it all his rugby club has also suspended him, an overly harsh outcome for some rash, stupid comments.

You can argue 56 days in prison is harsh (I agree), but my main problem is this guy getting punished multiple times for the same crime. Once this went to court they could have:

1) Noticed the punishment given by the university and deemed no further punishment was required.

2) Asked the university to reinstate him + offer some form of counseling, and punish him through the legal system.

I fail to see how this is of benefit to anyone, you now have a guy with a criminal record, debt, and 3 years of wasted eductation with nothing to show for it. It's just far to harsh. I wouldn't be suprised if this guy made being a criminal a lifestyle choice as he seems to have little options left.

Not in itself, I agree. I was merely trying to put the situation into context. He's young, obviously a bit of an idiot AND he was intoxicated - at least he claims to have been and I'm inclined to believe that. All of these things ought to be have been taken into account when sentencing but sadly, it appears they weren't.

I have no doubt he was, he's a rugby fan and this was the day of Wales 6 nations win. I was viewing twitter as this unfolded and if you reviewed the guys past tweets, you would see he had no history of this sort of thing. It just seems like he got drunk and had a monumental brain fart.
