The Police in general as an organisation are scum and will try and punish you to bulk up their numbers, treat them as the enemy. There are individual officers who I deal with regularly and some who post on here who come across as decent folk out to do good, this is not an indictment of all Police officers as individuals, its just how the system works over all.

The Highway Code recognises filtering and failure to comply with Section 211 by a driver that takes out a biker could therefore influence a claim.

On the other hand, as already mentioned it also states you must not overtake when approaching a junction, or when approaching zig zag lines at a crossing

difference is though this time, is that the guy on the motorbike was not allowed to filter because of the markings at the pelican crossing.

He was contravening the road markings overtaking when specifically told not to.
 
Having spoken to the police handler this morning, the case will not be re-evalauted.. so i have the option of taking the driving course or going to magistrate court. Got a week or so to decide which option to go with.
 
Overtaking a stationary line of traffic on the wrong side of the road approaching a junction allowed?

Like hell it is?!

Is an overtaking manoeuvre, filtering or not, not done at the risk of the rider? Does the rider not have a duty to ensure the junction he is about to pass on the wrong side of the road is clear?

Why was he approaching it at a speed in which he could not stop?

I absolutely cannot believe the biker had right of way there. Allowed to filter through traffic on the wrong side of the road, yes - Has right of way to do so? Yeah - not so sure about that. Telling me cars on their side of the road must give way to a bike filtering through traffic in their lane?
 
I'd say although you are not really at fault, the easiest and best way to deal with this is to pay for the course and move on. Court will add a lot of extra work and stress, having to prepare things, take time off work, speak to solicitors and so on.

For the sake of £100 odd just pay for the course.
 
the fact that you go on this course it means your details stays on a police database for 7 years..

Your personal details are protected by the Data Protection Act 1998. If you elect to participate, you agree to your details being checked by us against the ACPO national database to establish if you have completed a similar Course within the last 3 years of this offence.
If you complete a “National” Course, your details relating to the Course will remain on file with the ACPO national database for road safety research purposes for a further 7 years from the date of the offence, after which any personal reference to you will be erased. These details will not be released to any other party apart from other UK Police Forces if they are considering making an offer of a Course in the future.

The cost of the course is £182.60 and means taking a day off work. So similiar to going to court i take it??
