Had a motor accident - who is to blame?

Just claim that you were also in the taxi and got whiplash and the claims should cancel out.

Someone drove into me once after looking left and right. Do some people just not look forwards ??? Sorry op but theres no excuse not looking ahead of you when moving forwards.

On my way from going left to right, I happened to be looking forward - the sweeping motion of my head means I cover the front angle too - I didn't close my eyes when head was facing forward.

I get your point though - in the second or so since the road was clear in front of me, I should have looked again. To be honest, the traffic was quite busy and I did not even consider the possibility that someone could find a break in the traffic to safely cross the carriageway and park on the opposite side of the road (my side) facing the wrong way in front of the exit I was on.
 
Panic breaking usually involves hitting the pedal!! :D

That is so true.

The panic breaking didnt make me miss the pedal so much as my big feet are not used to driving a van and the small, close together pedals it has - I have size 12 feet and when I tried to stamp down on the brake, it pressed the accelerator too so had very little effect, if you know what I mean - I should have worded that better. With a bit more time to drive the van, I would probably eventually get accustomed to the narrow pedals but I only picked it up after it was getting new tyres - was doing someone a favour

I looked left, he wasn't there, I looked right, road was clear, pulled out, saw him in front of me - tried to slam on the brakes but missed the pedal in a panic - was only doing 3 miles per hour so there isn't a lot of damage really - just my pride hurt more than anything

So reading this, you looked left, looked right, then pulled out?
Correct?

The correct procedure is look left, look right, look left again before moving, as that is the direction of travel and anything could have moved into your path, such as an idiot pedestrian, cyclist, or in this case, a taxi.

Suck it up, put it down to experience and drive properly in future.
 
Doesn't traffic drive on the left, i.e. look right? Also, isn't it a good idea to look in the direction of travel too?

EDIT: Actually never mind, just look everywhere :)

If this is the case then You are to blame, You can't go driving into things that are stood still & blame them. :p

Don't get me wrong - I am not trying to squirm out of it - just trying to get an understanding of it - it has actually left me confused and, no doubt, I will be a better driver for it - every cloud has a silver lining. Live and learn

No - the taxi hadn't stopped - it was pulling up on the double yellow lines in front of the garage exit, driving the wrong way against the flow of traffic.
 
Not sure why some are being harsh. No one else ever had a car or bike just appear out of nowhere? I had a close call the other day, an idiot tailgating me when the speed limit changed from 40 to 30, so I indicate to change lane, check mirrors, move over then suddenly there's a bike right behind me which came from nowhere, which I probably just missed, the idiot was speeding. I've also had plenty of idiot black cabs who just stop suddenly in the middle of the road to pick up or drop off passengers, or make sudden u- turns amongst loads of other awful driving. Unfortunately for OP you got caught out by these idiots who dont have any respect for road etiquette's.
 
If the taxi was stationary, you're to blame. Doesn't matter if it did anything illegal in the first place, it was stationary.

Info is from a previous claim. Again, could be wrong.
 
Sorry, what? You bought the things, how could you not know what they were? Unless you simply asked for the cheapest nastiest tyres you have in stock please?

I DIDN'T buy them - the van was dropped off by someone else and they arranged the tyres. I simply took the phone call that said the van was "ready" so I went down to pick it up, thats all.
