Help with work

I recently refused to a 'reasonble request' of moving some stock on a electric barrow and now i'm up for a discipline :mad: i refused beacuse the place i had to do it has 15 reach trucks flying around at 1 time and i don't feel safe/comfortable, so even though i feel at risk of harm do i still have to do there request?
 
If you still feel at risk of harm, still dont do it. I doubt they would have a hard time making anything stick when it comes to health and safety.

BTW, who do you work for?

i said all this in the interview before, i didn't think that they could force anyone to do something they don't feel safe with and then i got the letter today about the discipline

If you want to be clever write it down/record it in the accident book, every organisation should have one by law. This may constitute a electronic recording system or a book, could even be a form you fill in. At least that way something is on record about the area where the machines operate :)

Also by law it would be classed as a near miss activity in the work place, hence you could say "I don't wish to work there as lift trucks are rushing around and I don't feel safe, especially when one time one almost hit me" <-- thats a near miss or untoward occurence. If however you were off work because one hit you (more than 3 day) then by law the organisation has to forward this onto the HSE and record it on a F2508.

Thus by doing your job you are threatened with discipline then you could argue if I was taught how to use the safety/lifting apparatus then I would be happy to oblige (covered yourself).

Also by law it is the employers duty to ensure his workers are in a safe environment and various other things but you don't need to know that for now.

But he wasn't actually nearly hit by anything, so what if 15 trucks are moving around at once, it's a bloomin courier business what do you expect. He was asked to do something, move some stock on an electric barrow, hardly dangerous, it was an electric barrow as well, little effort required. Sounds to me like the op is refusing to do his job because he is a wuss or just lazy. Maybe the disciplinary will teach you a lesson.

If I was a superviser I'd have very little patience with such an attitude.

Perhaps its me but surely you need training in operating machinary? I think if an 18 yr old was a supervisor I'd laugh at him :D

its not bad, at least now I have ammunition behind me when complaining about work environment to upper echelons of management... always nice when you have 'Health & Safty' paper work and notices about :)

the thing is i'm a packer not a someone who is ment to empty trailers or something, i'm also not lazy you have no idea what i'm really like so please keep your attitude out the thread.

Also i just called H&S and since i didn't have the training i needed to do the job i shouldn't really be getting a discipline, and if i haven't had the propper training the company is putting me and others in danger

Congrats thats what they should say I call that a case closed, hope the boss gives you a big smacker on the lips and thorough seeing too ;) :p :D
