How to update my SSD firmware with windows installed on it?

My agility 3 has the release firmware on it, as it came in a pre build from OCuk, its the only drive i have and from what i read the drive needs to have nothing on it to update the firmware, is that correct or can i update it in windows? Im getting a new SSD when natwest give me my frigging wages, should i just wait til i get the new one, update the new drives firmware, clone my old drive to it, then update the old drives firmware?
 
im not 100% sure maybe someone else can comment further but to update firmware your ssd has to to be the secondary none booting drive,so for example you have to use another pc with the os on another drive or a second hdd with the os and booted from it

idk if you lose your data or not im guessing not but its advised to back up just incase ect

Your correct, just read this on OCZ's site in the downloads section.

*CURRENT FIRMWARE RELEASE is v2.22

Updating the firmware from the toolbox is not supported when Windows is running off the drive you are trying to update.

-Toolbox will not update a primary system drive (e.g. drive letter "C:"). You must run Windows from another drive and then update your SSD using Toolbox.
