This happens to me all the time.

Trucks in the UK are limited to 40MPH on A roads, thus as I'm paid by the hour, I tend to stick religiously to 40 MPH, I get re-incarnations of Zip taking insane risks to get past me and often, some will really slam on the anchors once past me.

A few years back this very thing happened to me in my truck, I slammed straight into the back of the car (not intentionally I hasten to say) and having checked the driver was ok, he got thumped for his trouble. :o

The Police, having advised me not to mention the bit about me whacking him(!), prosecuted the bloke succesfully for dangerous driving. :D

I always thought in such a situation, as I had run into him, I'd automatically be seen to be in the wrong, it appears not to be the case.

The Police are not all bad, not by a long way.

My Mrs went into the back of a car and the bloke in front got the blame. He was taking an automatic for a test drive. He had told the dealer he had driven auto's before... lie, he hadn't

Pulling away from traffic lights, and at the point you would change gear he tried to, in an auto  , pushed his foot down on the brake thinking it was the clutch, he comes to a complete stop and Angela hits him.
Not much damage to our car, being the Disco we had at the time, but all his boot and bumper was pushed in.

She called the police and said what happened and he was honest enough to admit what he must have done. Insurance companys put him at fault as well.
I've always wondered if he bought the car knowing it had been in an accident :D

So as you say, the case of if you hit someone from behind its always your fault isn't true in some cases.
