Involved in a crash....

Just been involved in a crash. GF was driving (I'm laying across back seats as I cannot bend my leg yet) and pulls into our cul de sac. She pulls round to reverse into a space (bays at the end of the cul de sac). She stays stopped in the road as she needs to get me out of the car before reserving in because I can't get out of the car in a tight space.

In the mean time someone has reversed off his drive without properly looking and gone into the passenger side front arch and door.

Blue car is us, arrow is our entry and the blue x is where she would have reversed into. Black squares are cars parked in the other bays and red lines are different drives and his car. Red arrow shows his line of movement. As I'm laying across the back seats I see perfectly that he just didn't see us, we had been stationary for a good 10 seconds and he moves slowly (5-10mph) into us.

He stops and gets out, most of the attention is on me as it's jarred my dodgy knee and I'm in a lot of pain (it's gone away mostly now though - still hurting a bit as my leg needs to be kept 100% straight and was right up against that side of the car). We didn't get insurance details as I was in pain, GF was shaken up and crying and he was clearly going out. He agrees to come round and see us when he gets back in while I calm the GF down.

Just want to check this should surely go our way? We were stationary on a public road and he has reversed off his private driveway and gone into us.

The back of his car (11 plate Skoda Octavia) has a few mark but our car (54 plate VW Polo) has taken most of the damage, door is no longer sealed and you can put a finger through the gap. Doesn't shut properly and wing mirror has been shunted closed and won't open.

Few images of the damage, car has 104k so probably only worth £1.5k-£2k and she still owes £1k on it. GF has told her insurance company but hasn't opened a claim, waiting for the other driver to come home and see what he says.

No witnesses, I saw everything from the rear seats. No one else about though. No pictures of the cars in place either. Hope it's a company car and he just owns up, or owns up anyway as my GF has always got on well with the family (spoken a few times, been friendly etc...).
 
You were stationary, he drove into you. His fault 100%. Though without any witnesses he may not stick to the truth the whole truth and nothing but the truth...
 
He's not admitted fault per say, but he has said he reversed into us and checked a mirror but agreed we were probably in his blind spot and he didn't check.

He's given us all of his details and insurance details, and we've given him out names and phone numbers but not our insurance details.

He's gonna phone his insurance company tomorrow morning and then we'll phone tomorrow afternoon and start the claim, we let the GF's insurance company know what was going on.

Sounds like it all should go to plan, he asked about doing it outside of insurance as his excess is £550 but he had 5 years NCB and it's protected so I honestly said I thought it would be much cheaper and easier to go through insurance for both parties and he agreed.

The damage to his car is minimal, 1 small dent below a TDi badge that should pull out and 2 small scratches that look like they've just taken the paint away and could be done by a chips away type of company.
 
Just phoned his insurance company now as found out they were open, have opened a claim but we could hardly understand a word the person on the other line was saying due his very thick Asian accent and terrible grasp of english.

He did say (we think!) that we should call our insurance company and open a claim with them and get the car recovered tonight as the door doesn't quite shut properly. We've taped it up and locked the car so you could not break into the car any easier and rain won't get in now.

I'm very tempted to give Help Hire a call in the morning.

What are peoples opinions?

Don't do this, you'll lose NCB etc. etc. and it'll be massive hassle.

Someone crashed into me and I called my insurance opened a claim and lost nothing. It wasn't my fault and if what OP says is correct and judging by the drawing then it wasn't his fault either.

To be honest there is no way anyone can not deem the other party responsible
