He can't be done for assault, because he was using reasonable force in defence. Far too many people have no idea what the law is and just believe any old crap they heard from somewhere about how anyone can commit any crime they like, no-one is allowed to defend anyone or anything and the only reason the law exists at all is to protect criminals. It's all a silly lie, but many people believe it because it's been repeated often enough.
 
Unfortunately the law protects those who themselves break the law in the worst possible manner.

It doesn't. Very few householders have been prosecuted for the use of force against an intruder, even if the intruder ends up dying. Those that have usually go far beyond "reasonable force".
 
McCalium, a cocktail barman, was sentenced to four-and-a-half years in jail after being convicted of aggravated burglary.

Kinda shows all those people who say "zomg you can;t touch a burglar" that it's a pile of twaddle and you can defend your home.
 
I read that McCalium (the guy who got his ass handed to him) said that the old dude pulled him into his house and just started beating him up for no reason...

This story just gets better :)

Nope he threw a knife at him which luckily missed. It could have hit him and he could have died. Would it not go down as attempted murder/manslaughter?
 
I'm very pleased for the old chap.

I am firmly of the opinion that if you break the law, then you should be unable to be protected by it.

Hats off to the elderly gentleman.

I asked a friend one day what would you do if some one came into your house when you was asleep he said "Id feel sorry for them" lol but then he is a sociopath :D

Absolutely.

I am firmly of the opinion that if someone comes into your home like this then you should be able to do whatever you like to stop them (including beating them to death). Unfortunately the law protects those who themselves break the law in the worst possible manner.

Good job that you have nothing whatsoever to do with the law :)
