Hi all.

My brother got a speeding fine. He paid it off but a week late (due to having no money)

This morning they sent him all his money back along with a court letter.

What is likley to happen now? Seems a bit harsh to me.

seems like what it said on the NIP to me. Surely the letter will say what happens next

Fixed Penalty notices have a time limit attached to them - if you dont pay before the deadline, the offer of a fixed penalty is withdrawn and the offence is dealt with by a court.

Seems a bit harsh, they got their money (yes a week late). But they go through the trouble of sending all the money back to him and the bother of court dates.

Why can't they have just took the money! At least he has paid!

how long should the police wait, after the date they have set for any payments to come in? Deadlines a deadline.

A fixed penalty is a concession they make - technically all offences should be dealt with by court. But they give you a concession provided you pay in time.

He didn't.

Bingo.

Assuming it was a £60 an 3-points FPN, why couldn't he have sourced £60 within the 28 days or whatever it is you are given?

happened to my dad this, its a joke, these people who decide these things do not live in the real world, when it apparently "goes to court" all that happens is your sent a letter which you sign to say your guilty.

Whats wrong with this country?

Hes highley overdrawn, took him a while to get the money.

I'm just annoyed he didnt tell me as i would have paid it for him

They had the money in their hand, surely they got bigger things to deal with.

Oh well thanks for the info.

There is AMPLE time to pay the FPN.

These people DO live in the real world, and have most likely got on with other things they need to do, they have passed "late" speeding offences down the "line" to the next port of call, the courts.

Errr.. not if you dont have any money at a specific time of month??

He has a business, he has a lot to think about, you know? making sure there is enough work to keep all the lads employed and jobs are getting done ? helping the economy ? trying to better himself ?

Oh wait he should stop all that to faff about sorting out a speeding fine for going 33 in a 30 zone on his way to get a sandwich at dinner time ?

Why is the fact you may have no concept of financial management a concern of the legal system?

If you dont have any money dont speed then you wont need to pay a fine.

Dont you get 28 days anyway? Which would cover virtually everyones payday.

Precisely. It's not as if you have to pay the next day is it!

Perhaps he should spend a few minutes sorting his priorities before getting dragged off to court for petty motoring offences. Pretty sure NOT paying the FPN WITHIN 28 DAYS, takes more time and money than just doing it there and then.

If he runs his own business was the fine incurred using a works vehicle then he should have paid the fine via his company and then deducted the fine from his own salary.

If he is running his own company but cant find £60 in 28 days then something is wrong. If he simply forgot as we all do sometimes then I'm sorry but its a case of tough luck.

you're right, he should've sent that in a letter to the police.

Should that give him exemptions from law? :p

No but i dont see why he should have to go through all the faff of sending off a cheque, having it returned to him, going to a police station, waiting for a letter, and sending that back with MORE money because he was a couple of days late paying ? who won in that situation ?
