Man admits to rape of a 12 year old

I think part of the issue lies that the term rape covers such a huge birth of actions, when someone uses the word rape, people in their mind think of the worst types of sexually assaulting someone.

Perhaps for exceptional cases like these where the person is unable to consent legally, but has participated willingly, something such as "sexual relations without informed consent" needs to be used instead.

I highlight the word exceptional because it shouldn't be a "lesser" option available to child groomers etc, but purely for cases where there has been no malicious intent and agreed upon by all sides, the prosecution, the defense and the judge.

If the "by the book" warriors here want the law followed to the letter.

The 12 year old, being over the age of 10, the age of criminal responsibility. Has collaborated to commit rape by falsely representing her age and should be charged accordingly and also be put on the sex offenders register. Just as they can be if they post illegal pictures of themselves when no outside grooming influence has occurred.

Would that be OK? Or is this "it's the law" stance selective?
 
Gf (who doesn't usually get grabbed by headlines) said about this disgusting news article. 'Man rapes 12yo girl' I had read about it on here so recognised the story (yeah it was fb headline). I think rape is not the right word to attach. It has associations with forced sex obviously.

Poor bloke, you're hardly going to ask for id are you. Everyone also agreed she looked 18 +

It's not just that though. She behaved like an adult (partying and drinking), must have been dressed like an adult and to top it off, somewhere down the line, lied about her age. Her actions have probably ruined this guys life. It looks more like entrapment than rape to me!

I think the law is wrong labelling it rape when it was consensual. It raises further questions about the sex education or lack of that children are having, in that she thought it was 'ok' to go out and sleep with someone.

I guess at least he's got an interesting story to tell people.

Like if he starts a new grad scheme or something and they do some exercises getting to know each other:

'so each person tells us two true things about them and one false thing and we all have to guess...'

It wasn't entirely consensual, since he didn't give informed consent. Quite the opposite - she deliberately gave him false information to obtain consent she wouldn't otherwise have got. He didn't do anything wrong. She did.
 
Surely in cases like the this the parents should be charged with something? What was a child doing out late at night going to clubs?
