Everyone else thought she was at least 18 - the door staff, the bar staff, the police on the beat who'd spoken with her earlier, the taxi driver - everyone. She told him she was 17. The judge thought it was reasonable to think she was at least 18 and that was with the judge knowing she was actually 12.

So what you're advocating is that he be jailed for not having sufficient psychic powers to magically know that all the available evidence was wrong.

Human development varies a lot from person to person. There are outliers. A 12 year old could have reached their full adult growth. Not often, but it can and does happen. I recall one lad from school who was ~6' tall, strongly muscled and hairy at 13. It's stuck in my head because it was such a farcical mismatch in PE. Physically he was clearly a man and a big man at that. He was bigger, faster and so much stronger than the rest of us that competitive sport was quite silly.

Bear in mind that everyone thought she was an adult. Even the judge thought that she seemed to be an adult based on both appearance and behaviour (as judged from witness testimony and CCTV footage). What makes you think you'd somehow be aware that all the available evidence was wrong when everyone else wasn't? It's like all cons - we all like to think that we somehow wouldn't be fooled, but that's not a rational position. It's reassuring ourselves, stroking our egos or both.
 
Unfortunately (or fortunately, I should say), is that a lot of 12 year old children clearly look like 12 years old, or even younger. But there are always exceptions, so to say 'OMG why didn't you notice she was a child' is a fair comment most of the time. Most, being the operative word.

apart from this particular instance where several people who one can safely assume were not high/drunk even said they had no concerns over her age.

When I was 15 I was dating a 16 year old girl who's 11 year old sister looked older than her. :p

People develop differently.
