MM changes to profiteering rules and new Collectibles sub-forum

The computer hardware market has changed over the last few years and the OcUK moderating team feel it's time the MM rules were updated to bring us more up to date with recent trends.

We accept that sometimes the prices of items rise and therefore the second hand market prices rise as well so that something can be worth more than what was originally paid for it.

We are making a change to our rules regarding profiteering.

Rule 2.4.8 currently says:

"2.4.8 - Profiteering is prohibited. Our definition of profiteering is where any item has been purchased and advertised for more than the original purchase price, whether deliberate or not. We do not regard the sale of gifts, prizes and RMA items to be profiteering provided they are sold at the correct market price (please refer to rules 2.3.7 & 2.3.8)"

This has changed to:

"2.4.8 - Items may not be sold for more than the current retail price. We understand that prices fluctuate and current retail prices may be higher than an individual paid. You are not allowed to sell any item at a price that is higher than the current retail value.
Where items are discontinued or no longer available at retailers, then the retail price should be deemed to be the average price from appropriate online second hand retailer e.g. Ebay, CEX or similar"

This means that if you happen to buy the latest Hokeykokey2000 graphics card from OcUK for £399 and six months later, the retail price has gone up to £499 that you will be able to sell it for more than £399 but not for more than £499. Scalping is still expressly forbidden, you cannot buy and re-sell immediately for profit (such as pre-ordering the latest graphics card for £1,800 and then selling for £2,000).

Members who have been excluded from the MM in the past for profiteering may be eligible to have their exclusion lifted and should contact us via the FCD forum where each case will be judged individually.

Our rules on traders have not changed.

In addition to this, we have introduced a new MM sub-forum called "Collectibles" where you can buy and sell the following items:

Building kits (e.g. Lego)
Model kits (e.g. Airfix)
Board games
Table top games (e.g. Warhammer)
Trading cards (e.g. MTG, Pokemon)
Model Railway (e.g. Hornby)
Slot Car Racing (e.g. Scalextric, Tyco, AFX etc)

This list is not exhaustive.

We are open for suggestions of other items which could be allowed so if anyone has any suggestions for which other categories should be included, please open a thread in FCD for consideration.

Please note that NFTs are specifically NOT allowed.

This whole bolded sentence could do with a rewrite. I don't understand what you are trying to say there.
EDIT: I think you just need some more commas or better grammar structure? It reads badly. No offense @Feek :)

On 1st January, you buy a graphics card from OcUK and you pay £399.
On 1st July, OcUK increase the price to £499.

Previously you wouldn't be allowed to sell it for more than £399. Now you can sell it for more than £399 but not more than £499.

Given the level of pedanticism this forum can generate when it's just people's egos on the line, nevermind money, it's probably worth defining what is considered the 'current retail price' for this purpose (especially if OcUK don't sell it at that point in time) :p

If I wanted to sell my 7700XT for example, OcUK sell it for £399 but on Google shopping I can find an example of a "competitor" selling for £465+.

I think for clarity the maximum price should be the retail price on OCUK?

I think use some descretion here - if OcUK sell it then go by their price first.

Yes but given it's a profiteering rule, you need to consider that sometimes it won't be in stock, especially so on a new in demand product - using the 7700XT as an example still, of the 7 variants OcUK sell, 5 are not 'In Stock' yet display a price.

Imagine that's a 5090 on launch week, then it's the sort of thing I can see people arguing about because they don't think OcUK counts if it's not in stock etc.
 
Ah I see the mod team have finally got round to deciding to sell their collectibles :D

The profiteering change seems inevitable to enable the collectibles section to work, makes sense and I'm sure even if there are unknown unknowns down the road that crop up (they always do) they can be dealt with as and when :)

I'm not saying this should be done, but what do you think would happen if you just allowed people to set any price? Do you not think this will largely also police itself?
