MSI wont RMA new graphics card

A friend purchased a new PC from some internet cowboy outfit, the video card failed after 2 months,

They say ha ha go away (not purchased on a credit card)

I told him no issues we will return to MSI, MSI say ha ha go away its the sellers issue we don't care, i explained the seller will not help, they still say return to the seller, i explained the selling will not help again, they keep just sending back stock very long emails saying return to the seller.

I thought I could just return straight to the manufacturer?
 
If they have proof of purchase, which if bought on the web they should have, the seller has a legal obligation to assist.

No company can say Ha Ha its your problem.

even a visa debit has some level of protection these days I think, but any form of credit directly linked to the item is the best protect be it credit card or a "buy it now, pay in 3 instalments/12 months" deal.

Was it a VISA debit card? They are protected under the VISA chargeback scheme so you may be able to claim on that.

I'm not sure that a credit card would actually offer any protection as I'm not sure that this counts as a default or not under the consumer credit act.

The chargeback process lets you ask your bank to refund a payment on your debit card when a purchase has gone wrong. You should contact the seller first, as you cannot start a chargeback claim unless you have done this. Then, if you can’t resolve the issue, get in touch with your bank.

There are time limits for making chargeback claims. These depend on your card provider, so it’s best to contact them to get the details you need. Your card provider will also tell you what evidence you may need to provide to support your chargeback claim.

They can.

They will be ignoring their legal responsibility though.

I've had it recently a retailer quite blatently refused to honour, and literally just said said take us to court.

They are relying on the fact that some, maybe most people won't take it further.
 
Must be a really dodgy outfit to refuse a warranty resolution after 2 months. Was it definitely new/from a genuine retailer?
 
Is the retailer claiming any end user misuse which would render warranty invalid?
Has your friend water-cooled or modified the gpu in any way?
 
was this sold as brand new or 2nd hand?
do you have a link to the dodgy website? (note not wanting anyone to break occuk rules..... is posting a link to possible scammer site to warn them away considered linking to a rival?)
 
You can do a chargeback on a debit card, but it can take ages to go through. That will get their attention. The law is on the buyers side with this.

Request a chargeback as suggested, Chargeback could cover you if an item you’ve bought is damaged, faulty or doesn’t arrive. for anyone of these. Then go on to quote the financial Ombudsman Service and say that's what you were told, by them, it will help.

What is the reason the retailer is refusing to help?
a little more digging (my friend is a bit special) he was contacting the market place not the seller, i got the sellers details and they went into administration last year! (just after he got the machine).. I asked MSI is they might consider a direct return taking that into consideration ...
