what speed are you getting the errors at? if your getting the errors at or below stock speeds then yes return it, if your getting them at overclock speeds then I doubt you'll be able to RMA it as it runs at the specified speed.

It's meant to run 4-4-4-12 at 400MHz is it not? In CPU-Z it's reporting it's meant to run 5-5-5-18 at 400MHz

i have sorted out temps, reduced the voltage to 1.30v (from 1.45v) and temps are under/40c idle and 50/above load
