I'm curious as to how NDA's affect those that are not actually under one but are given info. ie if someone has been given pretty much all of the information for a hugely anticipated MMORPG that is in beta and wished to spill the beans so to speak. Does anyone know the legalities of such a scenario, if any at all?

they can say what they want only ppl under the nda have signed to say they wont spill the beans

When I was working at a past company we were about a release a new product from my team and The Times was offering £1500 to anyone who would spill the beans about it. As a student I probably should have done this :D

If you have agreed to nothing you can do what you like. The person you got the info from might get in trouble though, if they get found out. Chances are they wont, so spill away. :)

We really don't care about Warhammer Online. Yawn, and I am currently playing AoC anyways. :D

I was actually thinking what game it could be... I don't think there are many, if any, "hugely anticipated MMORPGs" being made at the moment and we already know about Warhammer and AoC, so it can't be them!

NDAs generally aren't worth the paper they are printed on. As far as I'm aware there have been very few occasions when they have been acted upon and I don't think that any of them have been successful.

Though I might be wrong.

You're probably in the clear, although the person that was responsible for you finding out may get into a lot of trouble.

PK!

And I thought one of the stipulations of signing it was that you didn't advertise the fact to anyone? The first rule of Fight Club is...

As said above, you don't have to sign anything as it is a law and so applies to everyone. They make you sign something to remind you about it or to make it seem official, just to make sure you understand it and so they have a record of that.

Thanks for all the info guys, it clears things up somewhat.

I was in the warhammer beta and it's nothing worth telling. Oh and you just broke your NDA by telling people you are in AoC beta, unlike WAR you are NOT allowed to tell anyone you are in that one ;)

I "signed" an NDA back when I worked for the Motor Industry. Broke it as soon as I left and told people I know all the dirty secrets and where not to buy cars from. Nothing ever came of it apart from I learned a lot about how corrupt the industry is, especially when it comes to finance deals.
