Nvidia making GameWorks Source Code Publicly available

It isn't the standard one, absolutely no one would use Gameworks if you had to pay for it and agree that it can be revoked without cause, that goes against every reason there is for paying for a software license, or for anything else.

Imagine a car payment plan, or a builder doing an extension or a contract for your job, if there was a clause that your car could be taken back, building work can be stopped or your job can be pulled without cause whenever the hell the other party likes... who would sign such contracts? Like right now, who when their income depends on the software being used, would agree to use a license such as that, the answer is no one remotely serious about developing games. The clause was very clearly added for this specifically and isn't the standard gameworks clause.

Nvidia have also stated that the licence in the root is under review and that their intention was to publish with the same licence as their code examples, which is basically a BSD licence link the one included in the subfolders, it could just be that the standard Game works licence has been published by mistake.


Well done for not being able to understand what you wrote yourself. I was responding more directly to the bit I bolded. You suggested maybe they published the standard Gameworks license by mistake. I explained why that wouldn't at all be a part of the standard license.

In what way have I not understood what you said?
 
It could just be an innocent mistake, i'd imagine it pretty easy to upload something and forget about a text file in it that should no longer be there... certainly it does not belong in an Open Source directory.

We will have to wait and see.

Except this wouldn't be an innocent mistake, that file would never be part of the original gameworks because the licensing clause is something that wouldn't be in a commercial contract because no one would agree to it.

If it can't have been part of the original gameworks licenses then it can't have been left in by mistake, it can only have been added specifically for this open source move. They may change their minds about it, but it was a deliberate move.
 
this is riddiculous, why ppl keep saying that Devs can get gameworks and use it for free ? where do you read that on the terms ?
it's not free of charge, it's royalty-free, it's completly different, anyone who download and use it, will see it revoked at 100% rate if the product is remotly successful if they refuse to pay a licensing fee to nvidia, or you could just from the get go ask nvidia for a contract to prevent it from being revoked, thats basicaly the clause talking about prior nvidia agreement to let you use it, which is basicaly the paying part.
we all read the same contract why do i understand it this way, and everyone understands it the other way ?
and the confusion here is that ppl assume things without making sure their definition of " royalty-free" is correct.
royalty free doesnt mean free, there is still a door open for license fee, and the rest of the contract talking about liability and revoking rights, make it crystal clear that it's not free, and there is a prior fee to use it without it being revoked.

Just gone from despising Gameworks to taking my hat off to Nvidia. Good move.

This needed to happen, it wasn't working the way it was.
 
ok heres a snippet from the terms and conditions on the Gameworks developer signup page.

• Termination - Your membership in this program may be revoked at any time, for any reason. It’s very unlikely this will happen, but that’s what happens when things are free. Sorry.

So no it does not cost you to sign up and use Gameworks.

Strictly talking, it isn't yet as they've only released Faceworks so far, it's likely that most will be opened up or so it's been said, well open'ish' at least, better than nothing from an AMD pov.:p
 
Wouldn't surprise me if current nvidia sponsored games run better on current AMD cards than current nvidia cards, Next gen it will be nvidia cards running better for thier sponsored games one way or another.
 
Would love to see it revert strictly back to the way it used to be, brute performance V brute performance and we could see an end of all this crap tbph.
 
The nvidia license clearly stayes that downloading the source code means you are automatically licensed to use the code under the terms and conditions. Thus without a royalty or license fee anyone can use it for free.
