OCZ agility 3 cold boot thread

As i am aware loads of people have similar problem when drive is not detected on cold boot , just want to have your opinion what did you do ?

did you send your SSD back refund money ?
did you replaced RMA it and it worked properly then?
did you managed to fix it ?
Are you waiting for a fix?

i've been trying to migrate win7 onto it for a week now i asked on ocz forums for any ideas, i'm getting read/write errors and no drive in bios, took it to work and pc picks it up ok but its too intermittant for me, gunna see what ocz say if no luck its refund time and get another corsair c300 in raid.
