In stopped traffic at a traffic light? I'm pretty sure I'm not supposed to be moving forward on a red light. By that rationale, you shouldn't move your vision from directly infront of you at all times, including but not limited to getting a bottle of water from a cup holder, or a tissue from a glove box or otherwise.

Ridiculous.

You shouldn't be doing either of those either! Pull over out of traffic in a safe place if you need to do those things.
 
it was in my hand but he wouldn't have been able to see it, its only because my head was tilted downwards that he 'assumed' I was using a phone.

Unless your going to go to court and lie that you weren't looking at the phone and that the phone wasn't in your hands (which I strongly don't recommend doing) he has you fair and square even if it is a bit unfortunate in the specific circumstances.

If your going to use the phone as a satnav then get a holder heh.
 
Unfortunately it seems you've learned the hard way.

Winds me up when I see people looking at their phone, head down, whichever it may be.

No sympathy from me I'm afraid, everyone knows the law and it's there for many reasons as I'm sure you know.

I'm sorry but I lol'd hard at this. You really mean to say that if a cup or bottle are in a cup holder to say the left of your hand where the gear shifter normally is and you felt like a sip you would, at a traffic light no less where you were in standstill, indicate out of lane, pull over to the side of the road, proceed to remove said cup from cup holder and then take a sip?

I bet my left nut you wouldnt.

I don't drink or eat anything other than a boiled sweet (which my wife unwraps for me) when I'm driving. If you're driving then you should be driving. If you want to eat or drink then pull over into a layby. What do you think layby's are for :confused: People have been fined for eating and/or drinking whilst driving.

I disagree with cup holders in car and a lot of manufacturers are removing them now. My cars don't have cup holder s- they normally go in rep mobiles and my cars are a calass above rep mobiles.

Yea I guess I just never realized that using a phone / sat nav whatever when the car is in standstill is still considered an offence. It doesn't make any sense to me. But I do find it comical at all the suggestions from people saying I should've known better, sorry but I disagree. It defies common sense that one cannot even for a moment shift attention to other things when the car is not moving or in danger of moving.

You may not see the lights til change until someone beeped, therefore due care and attention would likely come into it.

Everything about your arguement is just LOL. This is one of those situations where I am very glad most police use their god damn common sense and decide that taking a drink while stationary in a traffic jam isn't presenting a danger.
 
They need to start fining people smoke whilst driving as well, as that uses a hand too

inb4 pulling across 3 lanes of motorway traffic just to make sure I'm stationary on the hard shoulder with my engine off by the time I sneeze.

you will probably struggle to get insurance or pay an outrageous premium.

When you ring up for quotes, they will ask what your points are for and mobile phones whilst driving are one of the things they put major emphasis on punishing financially.

I hate to say it, but using your phone in satnav mode should mean you have the phone on a screen or dashmount so that it is visible in your peripheral vision whilst remaining focused on the road.

I can understand your frustration but acting like youve done nothing wrong is just silly. man up and accept it. learn from the mistake and avoid doing it again.
the fact that you dont agree with people saying you should have known better shows that you deserve the financial impact the points will have.

When stopped at lights you should still be using your mirrors to keep an eye out for filtering motor bikes, pedestrians and cyclists as a bare minimum something you'll find difficult looking down at your phone. Get a phone holder they start at £3 online.

I've had more near misses in slow moving town traffic than at any other type of driving simply because people do not give driving their full attention.
 
You got caught using your phone at the wheel. Be the bigger man and just deal with it, and buy a hands free phone holder.
