Everything about your arguement is just LOL. This is one of those situations where I am very glad most police use their god damn common sense and decide that taking a drink while stationary in a traffic jam isn't presenting a danger.

But coppers DO fine people for drinking whilst stationary............................

So why risk a fine? Just take a drink at rest stops instead.
 
I have no sympathy for people who get caught using a phone, be it for sat nav directions or anything else. Its a rule that is so well known and pushed so hard that claiming any ignorance of it is silly.
 
They need to start fining people smoke whilst driving as well, as that uses a hand too

That is absurd though. Smoking doesn't use a whole hand. just a couple of fingers. The hand can remain in use for control of the vehicle, just a smelly steering wheel / gear lever. There is no extra danger over and above that of changing gear, with respect to the hand being used to smoke, and manuals aren't illegal.

However, to the OP. Bang to rights I'm afraid. I have used my phone as a satnav a couple of times, but I have placed it precariously over the clock set and mileage reset spindles on the clocks. Sure, I can't see if I'm doing less than 30 mph, or my revs or time of day / date, but it is right where I need it, I don't have to adjust to see it, and I can be in full control of the car.

Obviously would be better with an actual holder, but I forgot my real satnav and holder that day.
 
I completely disagree with the above r.e smoking in cars. To say that you're still in control with a cig in one hand is naive at best, try driving around with a pen jammed inbetween your fingers and retain full, precise control of an emergency type swerve (not suggesting anyone does this on the motorway at8.30am) - though to be perfectly honest I see far more of an issue with the fact that it's not very difficult to drop it and burn yourself, or be distracted lighting it etc.

Once again though, them's the rules (Plus it's not really for discussion here).
 
It defies common sense that one cannot even for a moment shift attention to other things when the car is not moving or in danger of moving.

The law doesn't state that you must not momentarily shift your attention to other things whilst the car is not moving.

The law does, however, clearly stipulate what you must not do with a mobile phone whilst in control of a motor vehicle.

THe JML (*shudder*) grip n go available in supermarkets for 9.99 is actually pretty damn good for the money, certainly moreso than the eBay jobbies I've had.
 
Hope that phone holder you didn't buy of eBay was worth the £100.

Saying that, my TomTom was about £45 from some guy in a pub.

So you and those with a similar viewpoint are telling me, that when you stop at a traffic light, you don't look at any passengers in the car, you don't talk to anyone, you don't look at any of the dials or do anything whatsoever other than stare directly out of the windscreen infront of you in complete silence focused 100% on the road waiting for the light to go from red to green. Yes?

Yes. I do this and I wish everybody did.

I hate it when people don't move off instantly at traffic lights. It's a right pain in the **** when someone even adds even a two second delay at lights, it all adds up. People need to be poised to move off at a red light, not fiddling around with their crap. If everyone drove properly you could fit double the number of cars through the changes.

My sympathies op. It is a completely bs law that by merely touching a 'mobile device' you commit an absolute offence but sadly there's nothing you can do.
 
I have done this a couple of times but if I got caught I wouldn't be moaning on the internet about it.

same here . i know the risks and choose to accept them

by risks i mean the risk of getting caught. because literally no one else ever is at risk when im stationary at some lights with the handbrake on :o
 
I do exactly the same as the op

But I know it's against the law and would accept my fate should I ever get caught.

Of course I don't do it if there is a car nearby
