Fair enough for issues discovered POST release, a patch a few weeks after it comes out, sure. But to buy a new game, get it home, go to play and realise you cant until you download a patch just stinks.
I'd rather download a release day patch and have the game working properly than have no patch at all.
The release day patch fixes bugs flagged in the beta which obviously only ran for a month before release. By this time I'm sure it was too late to implement any of the fixes they were working on in order to comply with their release date (There will be numerous reasons behind why delaying would cost A LOT of money) because of how long it takes to go gold, make the discs and shipping them out worldwide. In hindsight, sure it might have been better to run the beta a bit earlier, but maybe they weren't ready.
Unfortunately there are ALWAYS going to be problems when your making games these days because of how complex they are. At least they are making the effort to fix them as soon as is possible. Not everything is as perfect as an E39.
