Opened and used item for a week, can I DSR?

I purchased a Razer Chimaera 5.1 from OCUK last week. It arrived friday and I have been trying to get it work correctly since Saturday. I have spoken to OCUK and Razer and both can't really help.

They work on the Xbox without any problems.

They don't work on the PC (sound drops out all the time), but while simultaniously playing back to the speakers, the speakers are fine.

Razers only help was to try to update the drivers which were already current, but updating to the latest betas hasn't done a thing.

I have tested the headset on different optical sound cards (all on boards). One won't push Dolby Digital so doesn't make a sound, the other doesn't have DD either, but will push a signal the headphones understand and they play back fine (albeit sounding crap).

I am currently playing back from the sound card into some Tritton headphones (optical DD 5.1) and they haven't dropped out once.

So I don't have anything to say "this is obviously at fault", so I was thinking I might DSR return them and just get a refund instead of running the gauntlet of returning something for "repair/replacement or refund", because they might not reproduce the results?

Do you think they will be excepted?

Remember that most onboard sound cards will not ouput 5.1 over optical. You will need a card that supports 5.1 over optical by using either dolby digital live or dts connect.

Otherwise, you will only get stereo output - which may be why one sound rubbish.

Can you not connect via rca?
 
You can DSR up to seven 'working' days (monday to friday) following reciept at your address. Not if you collected it though. You do not need a reason.

It's not onboard, it's a Creative X-FI Titanium HD outputting as Dolby Digital Live (for these, normally DTS for the speakers).

It's not that it sounds rubish per se, it's more that it cuts out for upto several seconds at a time.

Yes,

The DSR is in place to preotect you, the customer and to provide you the same as if buying in store. Ina store you would be able to test (if a half decent store:p) and see them out of the box. Only things exempt iirc are things liek software and such that comes with a single use code. NOT: Laptops/PCs that include acopy of windows are NOT counted as software despite what recently a few stores tried.
 
If you're going to use the DSR make sure you follow the correct procedure:

Under the Distance Selling Regulations (2000) you have the right to cancel the contract relating to your order at any time up to the end of 7 working days after the goods are delivered. To exercise your right of cancellation, you must give written notice to Overclockers UK by letter, fax or RMA WebNote giving details of the goods ordered and date received. if they arrived on friday(18th) then the 7working days should start on the following monday(21st), this means you have untill next tuesday(29th) to contact ocuk and ask for return under dsr.
