I sold brand new xbox360 arcade on bay on 25 oct posted the item on 27 oct througth parcelforce 48 buyer received the item on 29 oct at 10:30am after that no contact for a week.On 5 november got email from paypal that buyer wants his full refund becuase he thinks item is not as described and when he switch on the xbox360 it came with 3 red lights.

On my listing it clearly states that i accept returns within 7 days of receipt and abviously buyer did not contacted me about any problem within that period and it also states cleary that xbox360 is not registerd so new buyer will get full warranty with microsoft directly and with buyer bidding and finally buying the item he agreed to my terms and conditions.

I can understand 3 rrod is very common problem and it can happen any time but how come he took 8 days to check the item and becuase the xbox360 i sold got benq drive and buyer asked me 4 times to confirm which drive my xbox360 got so i am bit worried he probably tried to open the xbox360 to flash it and messed things up and now he wants his money back and today i got this email from paypal:

We have determined that the buyer, abc, is eligible for a full refund (including postage and packing associated with the purchase) for this transaction. To receive this refund, the buyer must return the item to you in the same condition as it was received. The buyer is responsible for the cost of returning the item to you.

Payment was still in paypal accout so they put hold on the payment so it looks like i have to issue full refund and get my item back and God knows in what condition.Any advise will be much appreciated in advance.

If he has messed around with it and flashed stuff then it is not in the same condition it was received so he will not get a refund.
 
That is it.

Paypal have made their decision, there is no changing it.

The buyer will pay for the return of the package, you will receive it. They will automatically take the money from your account, you cannot prevent this. Trying to will only have them sending over debt collectors.

Paypal sucks for sellers to be honest.
 
PayPal are a waste of space mate and you won't win either way :)
I disputed a non delivery - the dispute from start to finsh took something like 20 days due to their 'we have asked the other party for details' etc chuff.

20 days is plenty of time for them to empty their account and jog on.

Play them at their own game - empty your PP account, delete the bank cards from it and tell them to try their best.

That company should crawl back under the rock it came from.....shame their is nothing else as big as them to take them on, although Google Checkout isn't bad.
 
I think lot buyers abusing the paypal buyers protection thing.I don't think i will be selling any thing on bay in near future or even if i will payments will be through cash or cheque only.
 
I have used google checkout before and it seems ok.But country like UK how this company getting away with all this stuff.I am sure some one will be regulating this company.
 
LOL but on serious note if i do that,then there will be no difference between me and him.

To be honest if I was in your shoes I would try to argue the toss, end of the day you did stipulate that a refund can only be issued if you were made aware of any faults within a 7 day period.

Also have you contacted the buyer notifying him that he can get an RMA going with MS direct ?, maybe send him their support telephone number with the RMA process outlined.

Also if you are going to have to issue a refund ask him to pop the faceplate off the console and send you a picture conforming that the warranty seal is still intact.

Hi, Just to let you know that all the serials numbers from the xobx360 are recorded and i will inspect xbox360 for any kind of tampering becuase i know why you wanted benq drive and if i found any tampring i will take this matter to small claim court and police as well, i know why you paid £156 when you can get new one for £130 from the shops.People just abouse paypal buyer protection and i don't think so i will be selling any thing on ebay in near future because of buyer's like you.Thanks

That makes my brain hurt from all the grammatical and spelling errors. :(
 
As above, get him to post you pictures that the seals are intact before posting it to you. Keep copies of all the correspondence.
 
Paypal nearly always find for the buyer. I sold an article brand new, boxed and fully tested, exactly as described. After ten days the buyer filed a complaint that the item was "not as described" and after going through all the Paypal forms and stuff with me providing full evidence (I photograph everything I sell) that the item was as described, they found in favour of the buyer.

He returned it to me (I was expecting it to be trashed) in exactly the same condition as I sent it, the money was taken out of my account and I got my eBay fees back.

I relisted the item and sold it for more than the original sale.

When I checked his history, he did the same thing with someone else for exactly the same item!

But despite my numerous protestations to Paypal (including telephone calls), they refused to budge on their decision. The "Item not as described" excuse is poor and they seem to automatically find with the buyer.

I don't know why everyone gives paypal such a bad rap, surely you have to understand their position.
 
Buyer is not responding to my email's, i have asked him to provide picture before sending it back to me.

I doubt he will, if Paypal have told him to send it back to you by recorded means, they will just want the tracking number.

Once they get that they will just refund him.
