i have recently sold my phone on ebay, which completed friday (28th) now when i sent the invoice i said, i will send the item once payment has cleared INTO my bank account, as i have had problems before.

so monday morning comes around, and i have a Dispute opened up against me via paypal. "My item has not been recived"

i clearly stated that the phone would not be sent untill money was in my account. he has now put a hold on the payment - putting me at -£180 with paypal.

and is telling me if it is not sent today he wants his money back.

is there anything wrong with the way i have done this? i told him all along the phone wouldnt be sent untill i had money in my bank...

Hes probably a scammer and when he realised you werent biting he wanted out. Just stick to your promise and leave it upto him. If he refuses to pay just do a "non paying" thing with ebay and get your fees back.

One thing i dont understand if how you can be -180 with paypal yet the cash isnt in your account? where has this 180 gone? How can he do a charge back on something you dont yet actually have!

You should either have not accepted PayPal or sent the phone straight away.

Just because the money is in your bank account does not protect you from PayPal, if they chargeback they will just send the debt to debt collectors.

To protect yourself better on eBay request only bidders who have verified addresses, this allows you protection under the seller protection program.

well the phone is being sent out today anyway. but i just didnt understand why he got like this on monday. i mean the listing completed on friday. therefore it wasnt going to be sent untill monday at the earliest.

Like i say smells of scammer to me. Id not send the thing and just either loose your listing fees or sort something else out. Someone being like that so early is trouble IMHO. If you DO send the phone make sure its recorded so you can at least prove you sent it, but expect him to still deny he has ever gotten it anyway and he will carry on the chargeback.

Quite frankly selling mobile phones on ebay attracts scammers like wasps to honey.

How would sending the phone straight away have helped him?

Withdrawing the money then sending it is practicaly the same as sending straight away.

PayPal will chase bad debts.

If you suspect anything on eBay don't take the money from PayPal refund it.

I'd withdraw it, get the fees back, and then relist it, without Paypal as a payment option.

Paypal is nothing more than a scammer's best friend, and you'd be mad to use it for anything more than about £25.

Quoted for truth :)

he has a confirmed postel address

Send it and don't worry about it, provided you send it Special Delivery its safe.

I've sold plenty on eBay high value £600 + and never had any issue with PayPal provided the address is confirmed.

Remember to record the IMEI of the phone before sending though.

second getting the IMEI number, but in all honesty you should have said on your listing that it wouldnt be sent till cleared into your bank not afterwards, id be pretty narked if I paid (with confirmed account) then to be told it would be 5-7 days till it was sent

ok, i have the IMEI number for the phone, about to send via SD so will have traking number, any more ways to protect myself? what if he says the box is empty??
