Police and Courts fit for purpose?

I know someone who was arrested in October or November, had his electronic devices seized, and has still not heard if he'll be charged. 7 or 8 months!

I've not really had much experience of the criminal justice system, but that seems a ridiculously long time to wait.


Said devices probably haven't even been looked at yet - the backlog is huge. No decision has been made to charge because of a court ruling about six years ago. A judge decided that holding people on bail for long periods of time (inevitable as it took at least eighteen months even back then between charging and Court) was a Bad Thing. Now, the CPS won't charge until close to a possible Court date, and the Courts are now backed up for more than two years due to Austerity cuts. I know someone who has been awaiting that decision for over four years.

Four years?!!

It's just ******* with people's lives. This guy could be facing jail, is currently limited in what he can do in certain ways, and it's possible it may keep rolling for actual years!

It's got to be a human rights issue
 
I can only give experience of the met and i was lucky enough ( some might say) that caught the lot that were retiring from the late 80's so they mixed with the old old school. It was like a massive change over when i was in, might as well have been called anything but old bill when i left.

They are indeed ******* up the wind but to be honest there are some shocking standards these days, had one funny (not exactly funny but if you've done the job it has to be funny or you would go nuts) one when a call came in saying (this is from the suspect) that they had killed someone so night shift CID turned up and searched the property and i kid you not, this was written on the CAD (some will get that version of CAD) that they couldn't find a body but they found a bin that had been taped shut and they could smell a lot of bleach in the property. They tried to close the CAD but i pinged it back and guess what was inside the bin ? couldn't make it up lol.

i would say and it probably goes for other big civvy organisations that 60 percent graft the other lot just want to say they are in some sort of club. Its a shame to be honest.


If i am to be honest i think the old school way was better, yeah some of it was rough but things got delt with.

I'm glad I'm out but i really feel sorry for the ones that work hard and do it right, they get let down so much by the ones that are just in it for a uniform.
 
The Police lol, I was attacked in broad daylight in front of about 12 witnesses and CCTV cameras in a Tesco petrol station.
My mouth was bleeding so should be a charge of ABH right ?

I was wrongfully arrested in my teens and locked in a cell even though i had not done a crime.

So i get locked in a cell for nothing and a guy punches me and walks away.
 
At least they’re dealing with Otters stealing expensive fish out of ponds :D


But if your car gets stolen, oh well! :p
They might depending on the value of the car and your postcode.

I know someone who had a motorbike nicked that had a GPS tracker and the police wouldn't attend the retrieval of it from someones back garden

Nope charging standard for that assault would almost certainly be a s.39 assault (assault by battery) not a s.47 assault (ABH) and if the person admitted the offence and was otherwise eligible then a caution was the correct disposal.


Common assault or ABH: Decision on charge​

  • Unless there are aggravating features, the appropriate charge will usually be contrary to section 39 where injuries amount to no more than the following:
    • Grazes;
    • Scratches;
    • Abrasions;
    • Minor bruising;
    • Swellings;
    • Reddening of the skin;
    • Superficial cuts.
The guidance for cautions comes from the ministry of justice not the police or CPS
