Private pub

We used to hold regular house parties in my old house, at least monthly up to about 40 people max, never any trouble, but then we where a load of tree hugging hippies so the most rebelious it got was people rufising the mung bean stew and buying donner kebabs from the takeaway :D
 
could you bung a couple of cameras in there and say you were making a film about people who paid no attention to the smoking ban? i don't think the laws apply to film sets where it's in the course of making the movie/show.

But if I have a few beers in my fridge and my mate wants them to save a trip to the shops I will sell them to him. Is that theoretically illegal if he where to be smoking while all this was happening? Also could you give the beer for 'free' and they give a 'donation' to me?

If it were as simple as getting donations then do you not think other existing bar owners might have already tried it? It would after all be in their interests to maximise trade even if they've got to find a loophole to do it.

Buying drinks for your mates and then them giving you the money back for it i.e. at cost price to you, isn't an issue but you've got a rubbish business model there. Let's put it this way, I wouldn't invest in a business where you're not even going to break even after taking account of wages, premises, depreciation etc. The whole idea is something that you'd probably get away with on a small scale but it is almost certainly illegal and would be of interest to HM Customs and/or the police if it was anything more than very occasional and insignificant.

If Eastenders are still allowed to smoke on set, you could turn your 'private public house' into a 'film set'. Give everyone a script (stan: 'can I have a beer?' or Brian: 'fancy a cigarette') and put some cameras up for effect.
