Are you able to change the multiplier down to x6 (from x7) on that motherboard? I can do that on the ASUS P5B-Deluxe but not sure if its a standard feature on all boards? If so then try that and see if it takes the strain off the CPU. If there is such a thing as a FSB wall the chip won't be able to use the high FSBs even when its running on the x6 multiplier.

[edit] also have you added a little more volts to the chipset?
 
On the DS3 you can reduce the multiplier to 6x as opposed to 7x, which is what speedstep does presumably if it is enabled.

Its a common problem with DS3 and e4300, I dont know if its common to other 965 chipset boards too though.

I have tried upping the volts and the DS3 does allow me to go to the 6x multiplier but neither helped, as you predicted.

Im greatful for the help everyone but im going to sell the CPU and then I might go for the E6420 instead.

That sounds very similar to the prob i had a while back, hitting a wall at about 400nhz. Ty disabling "legacy usb support" in the bios and try again. It worked for me. I couldn't get past 395mhz at all, disabled this usb legacy thing and it went straight up to 450!
nothing to lose and everything to gain, give it a go and see how you get on.
